KCSIE MHST

England's school mental health system is not one document but three layers stacked together: statutory guidance that fixes duties, non-statutory advice that describes practice, and inspection and exam arrangements that decide what happens in the room. Keeping children safe in education 2026 came into force on 1 September 2026, replacing the September 2025 edition, and coverage figures published by the Department for Education in June 2026 put mental health support team reach at 5.8 million pupils. What follows is the framework in the order a student actually meets it.

Statutory guidance means a school must have regard to it, and inspectors or funders can hold the school to it; non-statutory advice only describes practice. Mental health and behaviour in schools, published on 16 June 2014 and last updated on 12 November 2018, sits in the advice category, while keeping children safe in education sits in the first, issued under section 175 of the Education Act 2002. Reading the label matters, because it tells you what a school cannot decline.

The 2026 edition appeared on gov.uk for information on 7 July 2026 and took effect on 1 September 2026; the document runs to 198 pages and part one alone to 50. The shorter version of part one for staff who do not work directly with children has been removed from Annex A, so every member of staff now reads the same text. Annex C lists the changes, and the training record behind it is material inspectors ask for.

The designated safeguarding lead is the first point of contact for anything touching safety, mental health or home circumstances, while the SENCo covers special educational needs and coordinates classroom support where learning difficulties overlap with mental health. A senior mental health lead owns the whole-school approach, the curriculum content and staff training, usually a deputy head or an experienced teacher. Headteachers and governing bodies hold the budget and the oversight, which is where it lands when mental health is written into a school development plan.

From September 2021 the Department for Education funded training for one senior mental health lead per school at 1,200 pounds each; applications closed on 31 December 2024 and the grant is recorded as ended on gov.uk. Two documents were added to the same page on 14 July 2025: learning outcomes for the role and a list of national peer support networks. Schools can still use both even though the money has stopped.

Mental health support teams are rolled out jointly by the Department for Education, the Department of Health and Social Care and the NHS, with three published functions: early evidence-based intervention for common difficulties, support for the school mental health lead to build a whole-school approach, and timely advice for staff plus liaison with specialist services. Each team includes education mental health practitioners working alongside senior clinicians, and handles mild to moderate anxiety and low mood rather than replacing specialist children's mental health services. Existing counsellors, educational psychologists, school nurses and pastoral teams sit on the same network.

Data published on gov.uk on 10 June 2026 puts MHST coverage for 2025-26 at 5.8 million pupils and learners, or 60% of the school and further education population in England, and 11,800 settings, or 48%. State-funded secondary schools are best served, at 79% of pupils and 78% of settings, with an average team covering 17 settings and about 8,200 pupils. A further 73 teams in waves 13 and 14 become operational during 2026-27, and the department projects 66% of pupils and 53% of settings by 31 March 2027.

Averages hide the gaps: only 42% of pupils in special schools and post-16 settings are in MHST-supported provision, and just 29% of post-16 settings are on the school-count measure, largely because teams are allocated per setting rather than per student. Anyone moving to a college for a post-16 course should ask before enrolment whether that college is on a team's list, and whether the team is on site or shared. Coverage says nothing about waiting times or how many sessions a student will get.

Ofsted began inspecting early years, state-funded schools and further education under the renewed framework on 10 November 2025, replacing the single overall grade with a report card that grades each evaluation area separately. Personal development was retitled personal development and wellbeing and now sits beside curriculum and teaching, achievement, inclusion, attendance and behaviour, and leadership and governance, on a five-point scale running from exceptional down to urgent improvement, while safeguarding is recorded simply as met or not met. Routine inspections resumed on 1 December 2025, initial teacher education and non-association independent schools moved across in January 2026, and Ofsted states that the new grades cannot be mapped onto the old ones.

The published whole-school approach puts curriculum, staff training, student voice and referral routes at the centre rather than adding a counselling room and calling it done. Health and relationships education are statutory in primary and secondary schools and include mental health content and help-seeking, while staff are expected to recognise signals and know where to refer rather than to diagnose. Peer support, mental health ambassadors and pupil surveys count as evidence, and a list of national peer support networks was added to gov.uk on 14 July 2025.

JCQ updates its access arrangements document each academic year, and the March 2026 revision changed section 5.1 from having to trial and exhaust supervised rest breaks to a duty to consider them before applying for 25% extra time. A supervised rest break pauses the clock so a candidate can stand up, look away or take a drink before restarting; JCQ says the rigid trial-first rule was not always practicable. Extra time still needs the two standing tests, namely that it is the candidate's normal way of working in class and that evidence shows a substantial disadvantage without it.

Section 5.16 of the same document covers an alternative room with one-to-one invigilation for a candidate with a serious medical condition, such as frequent seizures or Tourette's, or significant behavioural issues that would disturb the room. The revised wording frames the test around the impact on other candidates rather than the candidate's need alone, and no online application or evidence file is required. A same-day timetable variation is available when something changes on the morning of an exam, provided the date and session of every affected paper are recorded.

Attendance is wired straight into the framework: the Department for Education's working together to improve school attendance guidance became statutory on 19 August 2024. Registers are taken twice a day, so a half day counts as one session, and mental health can sit under the approved absence code I, which schools should not routinely back with a demand for medical evidence. Only four codes are unauthorised, a code N must be corrected within five school days or it becomes an O, and from November 2025 school-level attendance data goes to Ofsted each half term.

The bigger shift is statutory: the Children's Wellbeing and Schools Act 2026 received Royal Assent on 29 April 2026. Its scope runs wider than mental health, covering children's social care safeguards, support for care leavers, kinship carers, regulation of social work agencies, free breakfast clubs in state primary schools, limits on branded uniform, academy regulation and a register of children not in school. The Lords failed to add restrictions on children's social media access, while a Commons amendment on government guidance for mobile phones was accepted.

What a student can control is specificity: how many hours of sleep were lost, whether getting into the room for period one is possible, which week the work started to slide, and what support has already been tried in class, because that last point is the evidence behind the normal way of working test. Route the question to the right person and keep a dated record of who was asked and what came back. In practice, the students who get adjustments are usually the ones who raised it months earlier.
