An education, health and care plan is the strongest document in England's SEND system, bringing education, health and care needs into one text and setting out what a local authority must arrange. The law allows 20 weeks from request to final plan, yet fewer than half of new plans actually arrive within that window. This article covers who qualifies, how the timeline works and what the latest official figures show.
An EHC plan rests on section 66 of the Children and Families Act 2014 and on the SEND Code of Practice that took effect in January 2015, covering everyone from birth to 25. The plan is issued by the local authority rather than written inside a school, and the special educational provision it names has to be delivered. That is an obligation, not a statement of intent.
Coverage runs from birth to 25 rather than the compulsory school years alone. Needs in the early years are recorded in nurseries and pre-school settings, school-age provision spans mainstream and special schools, and after 16 the route may be a sixth form, a further education college or an apprenticeship. A plan stays in force while the young person is still in education or training, and stops when that ends.
Parents, young people aged 16 or over, and schools or colleges can all request an assessment, and a medical diagnosis is not required first. The local authority has six weeks from receiving the request to decide whether to assess and to tell the family the outcome, a deadline set in the SEND Regulations 2014. During 2025 there were 162,702 requests, up 5.3%, and 87.4% of decisions were communicated inside six weeks.
The statutory clock runs 20 weeks from the request to the final plan. Week six covers the decision to assess, week 16 the decision to issue, and week 20 the final version, with a draft that leaves the placement blank sent first so families have 15 days to comment and name a preferred school. In 2025 only 46.1% of new plans arrived within 20 weeks, slightly below the 46.4% recorded in 2024, while 10.3% took more than a year.
A plan is split into lettered sections. Section A records the child's views, B the special educational needs, C health needs and D social care needs, while E sets outcomes and F lists the special educational provision that must be arranged. Section F shapes daily support because it specifies frequency, duration and who delivers it, and the school itself is named later in section I.
A refusal does not end the process. Families can contact the local authority's information, advice and support service, which usually leads to a mediation meeting aimed at pinning down the disputed points. If the disagreement stands, an appeal can go to the SEND Tribunal over whether to assess, whether to issue a plan, the content of section F and the school named in section I. Most families file on their own rather than through a lawyer, and the deadlines are printed on the decision letter.
A plan must be reviewed at least once every 12 months. The review brings the school, family, young person and health and social care representatives together to check progress against outcomes and decide whether provision or placement needs to change; if the authority intends to amend the plan, it should notify the family within four weeks of the meeting. From Year 9, reviews must turn to preparing for adulthood, covering employment, independent living, community participation and health.
The Department for Education release of 25 June 2026 puts the number of EHC plans in force in England at 718,838 in January 2026, 12.5% above the 638,700 recorded a year earlier and the largest annual rise since plans began in 2014. New plans reached 110,708 during 2025, up 13.3%, while assessment requests grew 5.3% to 162,702, the slowest growth since 2021. A separate release from the same department covers only pupils on school rolls, so the two totals should not be compared directly.
Autism spectrum disorder is the most common primary need at 31.5% of all plans, followed by speech, language and communication needs at 22.3% and social, emotional and mental health needs at 21.4%; together the three account for almost three quarters of the total. Children aged 5 to 15 hold about seven in ten plans, while 39,351 plans cover young people aged 20 to 25. Among newly issued plans, social, emotional and mental health needs rose to 28.6%.
In January 2026, 649,500 children and young people with a plan, or 90.4%, were in an early years setting, a school, alternative provision or a further education college. Special schools accounted for 211,400 of them, an 8.5% rise, and further education for 100,800, of whom 79,500 were in sixth forms or colleges. Another 22,000 young people with a plan were recorded as not in education, employment or training.
Specialist SEND support in every school and community
On 23 February 2026 the Department for Education announced a £4 billion SEND reform package, including £3.7 billion of capital funding for 60,000 new specialist places, with about 10,000 already delivered. It also confirmed a £1.6 billion Inclusive Mainstream Fund and £1.8 billion over three years for an Experts at Hand specialist support service, moving provision back towards mainstream schools. None of this changes the assessment criteria or the appeal rights.
The most common mistake is treating the plan and the school placement as one thing: the plan sets out provision, while the school is named separately in section I. Another is relying on verbal agreement, when a short email after each meeting and a dated file of reports and decision letters does far more for a later appeal. Provision requests are easier to accept when they describe observable behaviour rather than adjectives, because a plan is revisited every year.
