England has a detailed legal framework for identifying and supporting pupils with special educational needs, and the operative document is the SEND Code of Practice for 0 to 25 year olds, in force since January 2015. It is statutory guidance rather than aspiration: it sets out who must notice a difficulty, when parents must be formally notified, how often provision is reviewed, and what the statutory deadlines are. This article turns that process into checkable steps and gives families waiting for an assessment a timetable they can hold a local authority to. A diagnosis is not the entry ticket; what matters is whether a pupil currently needs provision that is additional to or different from what their peers receive.

The Code adopts the definition in Part 3 of the Children and Families Act 2014; a pupil has special educational needs when a learning difficulty or disability calls for provision that is additional to, or different from, the support other pupils of the same age receive. Attainment alone does not decide this: the test is whether a pupil still fails to make progress once ordinary teaching has been adapted. Schools must also distinguish language acquisition from learning difficulty when a pupil is learning English as an additional language, and keep needs under review because they change over time. Waiting for a formal diagnosis before acting is one of the most common mistakes; support under the Code can begin on the basis of observed need.

The Code groups need into four broad areas: communication and interaction, cognition and learning, social, emotional and mental health, and sensory or physical needs. These categories exist to shape what a school does next, not to sort pupils into compartments, and the Code states explicitly that identification should lead to action rather than a label. In practice needs cut across the areas, so a pupil with autism may require support in all four, and speech and language difficulties often accompany other needs. That is why a full assessment looks at the whole picture instead of settling on a single primary category.

Support starts inside the classroom rather than outside it; the first response to a concern is high quality teaching with reasonable adjustments already in place, because most pupils make progress at that level. The strategies with the best evidence behind them are unglamorous: explicit instruction, scaffolding, flexible grouping, metacognitive approaches, and technology that removes barriers to reading, writing or calculation. Only when progress remains weak should a school move to more intensive, individualised provision. Pulling a pupil out for catch-up lessons while leaving the core teaching unchanged is a familiar and costly error.

Once a concern moves beyond ordinary teaching, the first stage of the graduated approach is assessment. The class or subject teacher works with the SENCO to analyse what is getting in the way, drawing on day-to-day assessment, previous progress, comparison with peers and national data, the views of parents, and the pupil's own account of school. Any concern raised by a parent has to be recorded and set against the school's own evidence; a family told that their worry has been noted, without a written comparison, can reasonably ask for one. For some types of need the pupil's response to a short, well-targeted intervention is the most reliable evidence available.

Where a school decides to provide SEN support, parents must be formally notified, and the plan is built jointly. The teacher, the SENCO, the parents and any specialist involved agree SMART outcomes: specific, measurable, achievable, relevant and time-bound. The written plan then records what support will be provided, how much progress is expected, and the date for review; verbal assurances do not satisfy this step. Pupils should take part as well, since the outcomes describe what they are meant to achieve rather than what staff intend to do.

Implementation carries a duty that is easy to miss: the class or subject teacher remains responsible for the pupil's progress even when part of the support is delivered by a teaching assistant or a specialist. Teaching assistants should supplement teaching, not replace it, and the EEF's 2020 guidance on SEND in mainstream schools states this without hedging; small-group work also has to connect back to what is taught in the main lesson. Constant one-to-one adult attachment can feel reassuring while quietly reducing a pupil's chances to work independently. The SENCO's job at this stage is to help teachers refine their own practice, not to take pupils off their hands.

The review stage asks one question: did the support produce the expected progress? The Code's wording is that actions are revisited, refined and revised, and the usual rhythm is once a term, with informal contact in between. Where progress is still weak, provision should become more intensive or new specialist advice should be brought in; pupils with an EHC plan have a separate annual review as well. Parents can ask three things at any review: was the outcome met, on what evidence, and what changes next.

Maintained schools must designate a teacher to coordinate SEN provision, and that person has to hold qualified teacher status and complete the national qualification for SEN coordination within three years of taking up the post, now delivered through the NPQ for SENCOs. Schools also publish a SEN information report each year covering how they identify and support pupils with SEN, how they prevent disabled pupils from being treated less favourably, and what facilities and accessibility plans are in place. The DfE's pages on gov.uk point families to these documents, which must be made available rather than kept on request only. For a parent, the report is the first piece of written evidence worth reading.

The most widely cited evidence summary for mainstream settings is the EEF's 2020 guidance report on special educational needs in mainstream schools, which makes five recommendations: create a positive and supportive environment for all pupils; build an ongoing, holistic understanding of pupils' needs; ensure every pupil has access to high quality teaching; complement that teaching with carefully selected small-group and one-to-one interventions; and deploy teaching assistants effectively. Its sharpest point is organisational, because when the SENCO carries SEND alone, teachers lose confidence in handling difference themselves. The report is free to download from the EEF website, and it is short enough to read alongside a school's own SEN information report.

The scale of the system is the reason this work is hard. The DfE release on special educational needs in England, published on 11 June 2026, puts about 21.0% of pupils at some level of SEN: roughly 14.8%, or 1,319,780 pupils, at SEN support without a plan, and about 6.0%, or 538,547 pupils, holding an EHC plan. The all-age count of active EHC plans in January 2026 was larger, close to 718,800, because it also covers young people aged 19 to 25 who have left school. Autism is the most common primary type of need among pupils who hold a plan.

Where a pupil's needs may exceed what a school can provide, parents, the young person or the school can ask the local authority for an EHC needs assessment. The statutory clock runs from that request: a decision on whether to assess within six weeks, a decision on whether a plan will be issued within sixteen weeks, and the finalised plan within twenty weeks, with at least fifteen days for parents to comment on the draft. Those deadlines slip in practice; the DfE release of 25 June 2026 shows that only 46.1% of new plans in 2025 were issued within twenty weeks. Refusals can be appealed to the First-tier Tribunal, and the appeal window is two months from the decision letter.

Support duties change shape at 16. Sixth-form colleges, 16 to 19 academies and further education colleges owe the same overall duty under section 66 of the Children and Families Act 2014, but the wording shifts: schools must secure provision additional to or different from what peers receive, while colleges must secure provision that is appropriate to the student's needs. In practice this puts more weight on the student declaring what they need and taking part in decisions, and an EHC plan can continue in further education until age 25. Contacting the new institution's support team before enrolment, rather than in the first week of term, is what keeps provision continuous.

The direction of reform is already on paper. The DfE published the schools white paper Every child achieving and thriving on 23 February 2026, alongside a SEND consultation that ran until 18 May 2026, with roughly four billion pounds promised over three years. The proposals replace the current two-category system with a tiered model and introduce digital Individual Support Plans, keeping EHC plans for the most complex needs. A white paper is not law: assessments under the new model are expected from September 2029, the first transitions no earlier than September 2030, and existing EHC provision is unchanged until then.
