What Is the UK Constitution and Why Is It Uncodified?
The UK constitution is not a single legal document but a set of rules drawn from many different sources accumulated over centuries. Unlike most countries, the UK has no codified constitution written in one authoritative text. Its constitutional rules are found in Acts of Parliament, judgments of the courts, unwritten political conventions, and classic works of constitutional commentary. The constitution is therefore described as uncodified rather than unwritten, since most rules are in fact written down somewhere, just not in one place. Understanding the five main sources is essential for Edexcel A-Level Politics, where exam questions frequently ask candidates to identify the five sources and explain the role each one plays.
Statute Law: The Most Authoritative Source
Statute law, or Acts of Parliament, is the most important source of the UK constitution. Because of the doctrine of parliamentary sovereignty, statutes passed by Parliament are the highest form of law: no court or other body can overturn them, and later Parliaments are not bound by earlier ones. Key examples include the Parliament Acts of 1911 and 1949, which limited the power of the House of Lords; the Human Rights Act 1998, which incorporated the European Convention on Human Rights into UK law; and the Constitutional Reform Act 2005, which created the Supreme Court and ended the role of the House of Lords as the final court of appeal. When asked which source is most authoritative, examiners expect statute law, because it expresses the sovereign will of Parliament.
Common Law: Judge-Made Constitutional Rules
Common law is law made by judges through the decisions they reach in individual cases. When courts decide a dispute, the ruling establishes a precedent that lower courts must follow in later similar cases. Over time these precedents build up into a body of constitutional rules that protect individual rights and define the limits of government power. The most famous example is Entick v Carrington (1765), in which the courts ruled that the Secretary of State had no legal authority to order the search of a private home, establishing the principle that government action must be justified by law. Common law remains central to British civil liberties and is frequently cited in Edexcel questions about the sources of the constitution.
Conventions: Unwritten Political Rules
Conventions are rules of political practice that are not legally enforceable but are nevertheless followed because politicians accept them as binding. Breaching a convention does not result in a court case, but it can provoke a political crisis. Important conventions include: the monarch always grants royal assent to bills passed by Parliament; the Prime Minister must be the leader of the party commanding a majority in the House of Commons; ministers are bound by collective ministerial responsibility; a government that loses a vote of confidence must resign; and the House of Lords does not block money bills or oppose the manifesto commitments of the governing party, a rule known as the Salisbury Convention. Conventions show how the UK constitution relies on political self-restraint rather than legal enforcement, a point examiners reward when candidates explain it clearly.
Authoritative Works: Classic Texts That Explain the Constitution
Authoritative works are books written by constitutional experts that are treated as sources of constitutional rules because of their authority, even though they are not law themselves. The three most important are: Walter Bagehot's The English Constitution (1867), which distinguished the dignified parts of the constitution, such as the monarchy and the House of Lords, from the efficient parts, such as the Cabinet and the House of Commons, and explained where real power lies; A.V. Dicey's Introduction to the Study of the Law of the Constitution (1885), which set out the twin principles of parliamentary sovereignty and the rule of law; and Erskine May's Parliamentary Practice, the authoritative guide to parliamentary procedure. When answering questions, candidates should be able to name the author, the work and its specific contribution.
Treaties and International Law
Treaties and international law form the fifth main source of the UK constitution. International treaties signed by the UK do not automatically become part of domestic law: Parliament must pass legislation to incorporate them. The clearest example is the European Convention on Human Rights: the UK ratified the Convention in 1951, but it only became enforceable in British courts when the Human Rights Act 1998 incorporated it. Similarly, the treaties signed on joining the European Community, given domestic effect by the European Communities Act 1972, were a major constitutional source until their legal effect ended after Brexit in 2020. Candidates should understand the difference between ratifying a treaty and incorporating it into domestic law, as this distinction appears regularly in exam questions.
Royal Prerogative: Special Powers Rooted in Common Law
The royal prerogative consists of the powers that historically belonged to the monarch but are now exercised mainly by the Prime Minister and ministers. These powers include declaring war and making peace, signing and withdrawing from treaties, appointing the Prime Minister and other ministers, granting honours, pardoning offenders and proroguing Parliament. The prerogative is part of the common law: courts can determine the extent of a prerogative power, though historically they could not question how it was used. In the Miller case of 2019, however, the Supreme Court ruled that Boris Johnson's advice to prorogue Parliament for five weeks was unlawful, showing that the courts will intervene when prerogative powers are misused. This case is a favourite source of exam questions.
Ranking the Five Sources by Importance
Exam questions often ask candidates to rank the five sources in order of importance and justify the ranking. The standard answer places statute law first because it expresses parliamentary sovereignty and can amend or abolish rules arising from any other source; common law second, because judges fill gaps left by Parliament and protect civil liberties through precedent; conventions third, because although legally unenforceable they sustain the day-to-day working of parliamentary government; authoritative works fourth, because they interpret rather than create constitutional rules; and treaties last, because they only take effect after Parliament incorporates them into law. The key to a strong answer is to state the ranking criterion clearly, such as legal force, practical constraint on government, or frequency of use in everyday politics.
九、考试中如何分析宪法来源(Edexcel真题思路)| How to Analyse Constitutional Sources in Exams
Questions on constitutional sources in Edexcel exams fall into three broad types. Knowledge questions ask candidates to identify the sources and give examples, such as outlining two sources with one example each. Analysis questions require an explanation of how a particular source works, such as why conventions are regarded as binding despite having no legal force. Evaluation questions invite a judgement, such as whether parliamentary sovereignty remains the central principle of the UK constitution. A strong answering framework is define, exemplify, evaluate: give a precise definition, cite a specific Act, precedent or case, then discuss limitations or controversies. Accurate definitions and concrete examples are what separate A-grade answers from weaker ones.
Common Mistakes and Revision Advice
Three mistakes are particularly common among students. First, confusing an uncodified constitution with having no constitution at all: in answers, emphasise that the UK constitution is uncodified, not non-existent. Second, confusing conventions with law: conventions carry political consequences when breached, not legal sanctions. Third, failing to give examples: for identification questions, memorise at least two examples per source, such as the Parliament Acts, Entick v Carrington and Bagehot's The English Constitution. For revision, build a mind map of the five sources with two Acts or cases attached to each, then practise one 10-mark evaluation question using the rank-and-justify structure and ask a teacher to mark it. Regular retrieval practice of the examples is more effective than re-reading notes.
