What Is a Constitution and Why Does It Matter?
A constitution is the set of rules that determines how a state is governed. In political terms it answers three questions: where does power lie, how is power exercised, and what rights do citizens hold against the state? For Edexcel, the UK Constitution topic sits at the start of Component 2 because every other institution, from Parliament to the Supreme Court, is defined by constitutional rules. A constitution can be codified, meaning written in a single document, or uncodified, meaning spread across many sources. It also establishes the relationship between the executive, the legislature and the judiciary, and it defines how laws are made and challenged.
Why Is the UK Constitution Uncodified?
The defining feature of the UK constitution is that it is uncodified: there is no single document that ranks above ordinary law. Britain never experienced a revolutionary break comparable to 1789 in France or 1787 in the United States, so its constitutional rules accumulated gradually over centuries. Key principles were established through Acts of Parliament, judicial decisions and political practice rather than through one founding document. This gives the constitution exceptional flexibility, but it also creates uncertainty, because no authoritative text exists to settle disputes. Students should note that uncodified does not mean there is no constitution; it means the rules are found in a variety of sources rather than in one supreme document.
Five Sources of the UK Constitution
There are five sources of the UK constitution that Edexcel expects candidates to know. First, statute law: Acts of Parliament such as the Scotland Act 1998 and the Constitutional Reform Act 2005, which form the most important source. Second, common law: rules established by judges through precedent, for example the right to personal liberty. Third, constitutional conventions: unwritten political habits that are not legally enforceable but are followed in practice, such as the convention that the Prime Minister must sit in the House of Commons. Fourth, authoritative works: writings such as Dicey's Introduction to the Study of the Law of the Constitution and Bagehot's The English Constitution. Fifth, treaties, including the European Convention on Human Rights. Knowing how these sources rank and where each is limited is essential for definition questions.
Parliamentary Sovereignty: The Heart of the Constitution
Parliamentary sovereignty is the most important principle of the UK constitution, classically defined by Dicey. It has three elements: Parliament can make or repeal any law; no Parliament can bind its successor or be bound by its predecessor; and no body, including the courts, can override an Act of Parliament. Because of this, the UK has no system of constitutional review comparable to the US Supreme Court striking down statutes. However, the Human Rights Act 1998, devolution since 1997 and Brexit legislation have all challenged the principle in practice. A favourite Edexcel question asks whether parliamentary sovereignty has been weakened, so candidates should prepare evidence for both sides of the argument.
Rule of Law and Separation of Powers
The rule of law and the separation of powers are the other two principles that restrain government. Dicey gave the rule of law three meanings: no one may be punished without a fair trial under the law; everyone is equal before the law regardless of rank; and individual rights are secured through common law precedent rather than abstract declarations. The separation of powers, developed by Montesquieu, holds that the legislature, executive and judiciary should be held by different bodies to prevent tyranny. In the UK, the executive and legislature are fused because the government must command a Commons majority, so a strict separation does not exist. Nevertheless, the Constitutional Reform Act 2005 created an independent Supreme Court and strengthened judicial independence considerably.
Constitutional Reform since 1997: Devolution
The 1997 Labour government launched a major programme of constitutional reform, and the most far-reaching element was devolution. The Scotland Act 1998 created the Scottish Parliament with primary legislative powers, the Government of Wales Act 1998 created the Welsh Assembly, now known as the Senedd, and the Northern Ireland Act 1998 established the Northern Ireland Assembly. England has no parliament of its own, which makes the settlement asymmetric. Devolution changed the character of the unitary state and created the West Lothian Question, where Scottish MPs can vote on English matters but not vice versa. The continuing threat of a second Scottish independence referendum keeps devolution near the top of the political agenda.
The Supreme Court and the Human Rights Act 1998
The Constitutional Reform Act 2005 created the UK Supreme Court in 2009, replacing the Appellate Committee of the House of Lords. Justices are no longer members of Parliament, so the judiciary is institutionally separated from the legislature. The Human Rights Act 1998 incorporated the European Convention on Human Rights into domestic law: Section 3 requires courts to interpret legislation compatibly with Convention rights where possible, and Section 4 allows courts to issue a declaration of incompatibility, although they cannot strike down Acts of Parliament. Legislative supremacy therefore survives, but judicial power has grown. In Miller v Prime Minister (2019) the Supreme Court ruled the prorogation of Parliament unlawful, a landmark example of the courts constraining the executive.
EU Membership and Brexit: Constitutional Change
The European Communities Act 1972 gave EU law direct effect in the UK and established the supremacy of EU law over domestic law. In the Factortame case (1991) UK courts suspended the application of an Act of Parliament for the first time, a profound challenge to parliamentary sovereignty. After the 2016 referendum, the European Union (Withdrawal) Act 2018 converted EU law into retained EU law, and the transition period ended in 2020. Brexit restored full legislative sovereignty to Parliament, but it created fresh problems: managing thousands of retained laws and handling new constitutional tensions between the Scottish Government, Northern Ireland and Westminster. Questions on sovereignty and Brexit remain a core Edexcel assessment focus.
Should the UK Adopt a Codified Constitution?
Arguments for a codified constitution include clarity: a single document would define the limits of government power precisely and prevent prime ministerial overreach. It would also protect rights with higher legal authority and reduce political uncertainty. Arguments against include rigidity, because a written constitution is hard to amend quickly as society changes. Critics also argue it would hand major decisions to unelected judges, weakening democracy, and that the current system works reasonably well without consensus for change. A codified constitution might also make future crises such as Brexit harder to resolve through political compromise. Edexcel evaluation questions frequently ask candidates to assess the case for a written constitution, so a balanced argument with named evidence is essential.
Four techniques will improve marks on constitution questions. First, define key terms accurately, since a precise definition of parliamentary sovereignty, the rule of law or an uncodified constitution earns credit immediately. Second, deploy specific evidence: name the statutes such as the Human Rights Act 1998 and the Constitutional Reform Act 2005, cite cases such as Factortame and Miller, and give convention examples such as the PM sitting in the Commons. Third, distinguish description from evaluation, because questions worth 12 marks or more require arguments on both sides and a final judgement. Fourth, structure paragraphs as although-but sentences that concede the opposing view before reaching a conclusion. Building a timeline of reforms and sources as flashcards is the most efficient revision method.
Summary and Revision Checklist
The constitution is the foundation module of Component 2 and connects closely with Parliament, the executive and the judiciary in synoptic questions. Revision checklist: explain what an uncodified constitution means and why the UK has one; list the five sources with one example each; memorise precise definitions of parliamentary sovereignty and the rule of law; build a timeline of reform since 1997 covering devolution, the Supreme Court, the Human Rights Act and Brexit; construct two-sided arguments on whether the UK should adopt a codified constitution; and cite at least three cases such as Factortame and Miller with their significance. Working through these six items gives solid coverage of the constitution topic.
