📚 A-Level CAIE Law: Case Analysis in Action | A-Level CAIE
Case analysis is the core skill examined in CAIE A-Level Law. You may know dozens of case names, but marks come from applying legal principles to new fact patterns. This article provides a practical drill to sharpen your IRAC method, precedent handling and evaluation, so that legal knowledge is converted into structured, credit-earning argument.
CAIE questions rarely ask you to recall a case in isolation. Instead, they present a short scenario and ask you to "discuss liability", "advise X" or "evaluate whether Y has a claim". Examiners reward structured reasoning that identifies each legal element and tests the facts against it. Rote case summaries without application usually score low, even if the case law cited is correct.
The assessment objectives are balanced: knowledge of legal rules, application to the scenario, and analysis or evaluation. A pure case list can satisfy only the first of these.
Command words matter. "Advise" means reach a practical outcome for a named party; "discuss" means examine both sides and reach a reasoned position; "evaluate" means weigh the quality of the law or the reasoning, not merely describe it.
Marks are usually awarded for the quality of the link between fact and rule, so the phrase "because" is worth more than an extra case name.
2. The IRAC Framework | IRAC 框架
IRAC stands for Issue, Rule, Application and Conclusion. Start by stating the legal question, then set out the test from statute or precedent, apply each element to the facts, and finish with a balanced conclusion. Use the same framework for criminal, tort and contract scenarios. It gives your answer an examiner-friendly shape.
Issue → Rule → Application → Conclusion
ILAC and CREAC are close variants. ILAC replaces "Issue" with "Introduction" and is useful when you must define the area of law first; CREAC adds an explicit "Explanation" step before application, which suits long essay questions.
Time budgeting matters. In a 25-mark answer, roughly 10% of your time belongs to the issue, 20% to the rule, 55% to application and 15% to the conclusion. Most candidates over-invest in the rule and under-invest in application.
Signpost each stage with a short heading or opening phrase such as "The issue is whether..." or "Applying s.1(1), the appropriation is..." Examiners mark what they can find quickly.
用简短标题或开头语标示每个阶段,例如 "The issue is whether..." 或 "Applying s.1(1), the appropriation is..."。
3. Deconstructing the Scenario |
Before writing, spend two minutes annotating the scenario. Identify the parties, the event, the harm or loss, the legal category, and the specific offence or cause of action. This step prevents the most common disaster in exams: answering a question about tort with a criminal law answer.
Who is the claimant and who is the defendant? Who is your client? An "advise the prosecution" question requires you to argue the case for the Crown, not to sit on the fence.
Which legal category is engaged: criminal law, tort, contract, or the English legal system? Then narrow it: murder or involuntary manslaughter, negligence or occupiers' liability, formation or frustration.
List the material facts and separately list the gaps. If the scenario is silent on a fact that decides the outcome, say so explicitly and argue both branches.
4. Stating the Rule with Authority |
The rule section is short but precise. Quote the statutory provision where one exists, then use a case name only to explain or illustrate the rule. A rule statement without authority looks like opinion; authority without a rule statement looks like a case-list.
Criminal law: start with the statutory definition, for example s.1(1) of the Theft Act 1968, "dishonestly appropriates property belonging to another with the intention of permanently depriving the other of it". Then break it into the five elements.
Negligence: state the four-part test and then apply it element by element.
Duty of care → Breach of duty → Causation (factual and legal) → Damage not too remote
Contract: set out the requirement in dispute, for example offer and acceptance, consideration, intention to create legal relations, or a term implied by statute under the Consumer Rights Act 2015.
Never write out a full case note. One clause is enough: "Recklessness is subjective (R v G [2003]), so the defendant must have realised the risk."
5. Material Facts, Ratio Decidendi and Obiter Dicta |
Examiners frequently test whether you understand why a case was decided as it was. The ratio decidendi is the legal reason that binds lower courts; obiter dicta are persuasive but not binding. Confusing the two is one of the fastest ways to lose analysis marks.
Donoghue v Stevenson [1932] established that a manufacturer owes a duty of care to the ultimate consumer where there is no reasonable opportunity for intermediate inspection. Lord Atkin's "neighbour principle" is the reasoning that made the duty general.
R v Howe [1987] decided that duress is no defence to murder; the statement that it would also be no defence to attempted murder was obiter, yet it was applied in R v Gotts [1992]. Persuasive obiter can therefore shape later law.
When you cite a case, ask three questions: what were the material facts, what rule did the court apply, and how close are those facts to the scenario in front of you?
6. Applying the Law Element by Element |
Application is where most marks live. Take each element of the rule in turn, match it to the facts, and reach a micro-conclusion before moving on. This "element, fact, conclusion" rhythm shows the examiner that your answer is analytical rather than descriptive.
Use conditional reasoning where facts are uncertain: "If the jury accepts that Dan was aware of the risk, the mens rea of recklessness is satisfied; if not, the charge fails."
Work through theft as an example: appropriation (R v Gomez [1993] — assuming the rights of the owner), property (s.4), belonging to another (s.5), dishonesty (s.2 exceptions and the objective standard in Ivey v Genting Casinos [2017]), and intention to permanently deprive (s.6, R v Velumyl [1989]).
Do not ignore defences. Even in an "advise the claimant" question, a brief treatment of self-defence, duress, contributory negligence or volenti non fit injuria shows balance and protects the conclusion.
7. Handling Precedent: Following, Distinguishing, Reversing and Overruling |
Precedent is a favourite examination topic because the vocabulary is precise. Use the technical terms correctly and you earn marks quickly; misuse them and the whole paragraph collapses.
| Term | Meaning |
|---|---|---|
| Following | A later court applies a binding ratio because the material facts are sufficiently similar. | |
| Distinguishing | The court avoids the precedent because the material facts differ. | |
| Reversing | An appeal court changes the decision of a lower court in the same case. | |
| Overruling | A higher court declares an earlier rule from a different case to be no longer good law. | |
Hierarchy decides binding force: Supreme Court (formerly the House of Lords) binds the Court of Appeal, which binds the High Court. Crown Court and magistrates' court decisions are not binding precedents, though they are persuasive in practice.
Persuasive sources include Privy Council decisions, obiter dicta, and decisions of other common law jurisdictions. Label them as persuasive, never as binding.
R v G [2003] overruled R v Caldwell [1982] on recklessness, replacing an objective test with a subjective one. This is a model example of overruling and of the Supreme Court's power under the Practice Statement 1966.
8. Statutory Interpretation in Case Analysis |
Many scenarios turn on the meaning of a single word in a statute. When that happens, identify the words in issue, then use the appropriate interpretive approach and support it with a case.
Literal rule: the ordinary dictionary meaning is applied even if the result seems odd. In Fisher v Bell [1961], a flick knife displayed in a shop window was not an "offer for sale" under the Restriction of Offensive Weapons Act 1959, because in contract law a display is an invitation to treat.
