📚 IGCSE CAIE Law: Winning Strategies for International Competitions | IGCSE CAIE
Competitions in law reward exactly the skills that the CAIE IGCSE Law syllabus develops: precise rule recall, case-based reasoning, statutory interpretation and structured argument. This guide translates your classroom knowledge into a competition-ready strategy, with paired English-Chinese notes so you can revise both the content and the legal language at the same time.
Every section below follows the same pattern: read the English paragraph, then read the Chinese paragraph immediately afterwards. Do not skip the Chinese if your English is strong, and do not skip the English if your Chinese is strong; the repetition is what makes legal terminology stick under exam and competition pressure.
1. Understanding the Syllabus and Competition Links |
Start by mapping the CAIE IGCSE Law syllabus onto the typical stages of an international law competition. Most contests test legal knowledge through hypothetical problems, essay questions, negotiation tasks or mock trial rounds. If you know criminal law, tort, contract, human rights and the nature of law, you already own the core toolkit.
| Nature of law 法律的本质 | Jurisprudence essays, model UN-style committees 法理essay、模联式委员会 |
- English: Learn the syllabus structure first, because competitions rarely test a topic in isolation; they combine two or three areas in one problem.
- English: Keep a one-page table of every topic, its leading cases and its statutory provisions, and review it weekly.
- English: Note which competitions use written papers and which use oral advocacy, then train the matching skill.
2. Criminal Law: The Competition Favourite |
Criminal law questions often ask about actus reus, mens rea, causation and defences such as self-defence and duress. Competitors who can separate the physical element from the mental element, and then test each element against the facts, score highest because their answers mirror the way a real court reasons.
Actus reus may be an act, an omission or a state of affairs. Mens rea is normally intention or recklessness, and the two must coincide in time. Causation splits into factual causation (the 'but for' test) and legal causation (whether the defendant's act was a substantial and operating cause).
Actus reus + Mens rea + No valid defence = Guilt
- English: Defences to check every time: self-defence, duress, necessity, intoxication, insanity, automatism and mistake.
- English: Duress is not a defence to murder, and necessity has never been accepted as a defence to murder in English law.
- English: Recklessness requires that the defendant foresaw the risk and went on to take it; negligence is not enough for most serious offences.
3. Tort Law: Negligence Under Pressure |
Tort law questions usually turn on negligence: duty, breach, causation and damage, plus defences like consent and contributory negligence. In competition, examiners reward candidates who apply the three-stage duty test calmly rather than listing cases without linking them to the facts.
The modern duty test asks whether damage was reasonably foreseeable, whether there was sufficient proximity between the parties, and whether it is fair, just and reasonable to impose a duty. Breach is measured against the standard of the reasonable person, adjusted for children, professionals and emergency situations.
Causation again uses factual and legal tests. A defendant may escape liability if an intervening act breaks the chain of causation, and remoteness rules limit recovery to damage of a foreseeable type.
- English: Defences to negotiate: consent (volenti non fit injuria) and contributory negligence, which reduces rather than eliminates damages.
- English: In a damages negotiation, quantify medical costs, lost earnings, pain and suffering separately.
- English: Always state the rule, the case and the application in that order, one short sentence each.
4. Contract Law: Structure Wins Marks |
Contract law focuses on offer, acceptance, consideration, intention, terms, vitiating factors and remedies. Because these elements are tested in a fixed order, contract questions are the easiest place to gain quick marks, provided your structure is rigid and your authority is precise.
An offer must be distinguished from an invitation to treat, as in the display of goods or an advertisement. Acceptance must be unqualified and communicated, unless the postal rule applies. Consideration must be sufficient but need not be adequate, and it must move from the promisee.
Intention to create legal relations is presumed in commercial agreements and presumed absent in domestic ones, although both presumptions are rebuttable. Terms divide into conditions, warranties and innominate terms, and exclusion clauses must satisfy both incorporation and statutory reasonableness.
- English: Vitiating factors: misrepresentation, mistake, duress, undue influence and illegality.
- English: Remedies: damages (expectation and reliance), specific performance, injunction, rescission and quantum meruit.
- English: Remote and unforeseeable losses are not recoverable, so always identify the loss you claim and its measure.
5. Human Rights and the Nature of Law |
Human rights law asks you to apply rights such as freedom of expression and freedom of assembly to concrete restrictions, and then to justify the restriction using a proportionality argument. Competition judges look for balance: they want to see that you understand the state's legitimate aim as well as the individual's right.
Rights are usually qualified rather than absolute, so a restriction must be prescribed by law, pursue a legitimate aim, and be necessary in a democratic society. A well-built answer applies each limb separately and cites a case or a statutory provision for each.
The nature of law section introduces jurisprudence: legal positivism, natural law and legal realism. You do not need to defend a personal theory, but you must define each school accurately and show how it explains a real dispute.
- English: Key maxims to quote: ratio decidendi, obiter dicta, stare decisis, distinguishing and overruling.
- English: Statutory interpretation approaches: literal, golden, mischief and purposive.
- English: Language rules: ejusdem generis, expressio unius est exclusio alterius and noscitur a sociis.
6. Reading Statutes and Cases Like a Competitor |
Competitors read faster and more selectively than ordinary students. When you open a case, read the facts once, then find the ratio decidendi, then ask one question: which single sentence in this judgment would change the outcome of my problem?
Separate ratio from obiter dicta with a pencil mark. Ratio binds later courts; obiter only persuades. In a competition answer, quoting obiter as if it were binding is one of the fastest ways to lose credibility with a judge.
When reading a statute, note the long title, the preamble, the definitions section and the presumptions. A word may look clear until you place it beside the section that precedes it, and the surrounding words often fix its meaning.
- English: Build a case card for every leading case: citation, facts, issue, ratio, and one exam application.
- English: Write the case name from memory before checking; retrieval practice beats re-reading.
- English: Record the statutory section number, not just the Act name.
7. IRAC and the Art of the Legal Argument | IRAC
IRAC stands for Issue, Rule, Application, Conclusion. It is the default skeleton of every competition answer because it forces you to state the law before you apply it, and to apply it before you conclude. Examiners can award marks quickly when the structure is visible.
Issue → Rule → Application → Conclusion
A strong application paragraph uses connecting words of reason: because, therefore, however, whereas and provided that. A weak answer uses 'and then' repeatedly, which signals that you are narrating facts rather than arguing law.
强有力的适用段落使用表示推理的连接词:because、therefore、however、whereas、provided that。
Finish every answer with a firm conclusion. Many candidates write two pages of analysis and then stop without deciding the case, which costs the easiest mark on the paper.
- English: Allocate roughly 15 per cent of your words to the issue, 30 per cent to the rule and 45 per cent to the application.
- English: Address the counter-argument in one short paragraph, then explain why your reading is stronger.
- English: Never introduce a new case in the conclusion; conclusions summarise, they do not add.
8. Mock Trial, Negotiation and Advocacy Skills |
Oral rounds test a different muscle from written papers. In a mock trial you may act as counsel for the prosecution or the defence, examine your own witness, cross-examine the opponent's, and deliver an opening and a closing speech. Each phase has its own conventions and its own traps.
In examination-in-chief, ask open questions and let the witness tell the story. In cross-examination, ask closed questions and never ask a question to which you do not already know the answer. In both, keep your voice level and your pace slow enough for the judge to take notes.
Negotiation rewards preparation more than rhetoric. Identify your BATNA (best alternative to a negotiated agreement), rank your interests above your positions, and look for trades that cost you little but are worth a great deal to the other side.
- English: Open with a one-sentence theory of the case, then signpost your three main submissions.
- English: Object on a clear legal ground, briefly, and then sit down; do not argue with the judge.
- English: In negotiation, summarise the agreed points aloud before closing to lock in progress.
9. Handling Hypotheticals and Time Pressure |
Hypotheticals are designed to be dense. Read the facts twice: once for the story and once for the legal triggers, such as dates, ages, states of mind, amounts of money and any words spoken. Underline these before you write anything.
Then list the parties and the possible causes of action beside each name. A short issue tree costs you two minutes and saves ten, because it prevents you from writing about a party who has no claim at all.
| 0-5 min | Read twice, underline triggers
| 5-10 min | Plan the issue tree
| 10-70 min | Write in IRAC order 按 IRAC 顺序作答 |
| 70-90 min | Check authority, conclusions, spelling
If you run out of time, never leave a question blank. Write the issue and the rule in note form; a structured sketch usually earns more than a perfect answer that was never written.
10. Legal English and Terminology Drills |
Legal English is a register, not just a vocabulary list. Competition judges notice collocations: you 'bring a claim', 'discharge a burden', 'establish causation' and 'rebut a presumption'. Learning verbs together with their objects makes your speech sound professional within a single round.
竞赛评委会注意到搭配:你会说 bring a claim(提出请求)、discharge a burden(履行举证责任)、establish causation(确立因果关系)、rebut a presumption(推翻推定)。
Latin maxims should be used sparingly but correctly. One accurate 'ratio decidendi' is worth five misplaced Latin phrases, so practise saying them aloud until the pronunciation is automatic.
- English: Weekly drill 1: summarise one case in ninety words without using the word 'thing'.
- English: Weekly drill 2: convert three passive sentences in a judgment into active ones.
- English: Weekly drill 3: record a ninety-second oral submission and transcribe your own lapses.
11. A Twelve-Week Competition Training Plan | 12
Twelve weeks is enough to move from average to competitive, provided the plan alternates content revision with timed practice. Use the schedule below as a template and shift the weeks to fit your competition date.
| 1-2 | Syllabus mapping, case cards
| 3-4 | Criminal law and tort problem practice
| 5-6 | Contract structure and vitiating factors
| 7-8 | Human rights, jurisprudence, statutory interpretation
| 9-10 | Timed papers and mock trial rounds
| 11-12 | Feedback, error log, oral polish
After every practice round, write an error log with three columns: what went wrong, why it happened, and the specific drill that will fix it. Review the log before each session; it is the single most efficient revision tool a competitor can keep.
12. Common Pitfalls and Final Checklist |
The most frequent mistake in law competitions is reciting facts instead of arguing law. A judge does not need the story repeated; the judge needs the rule, the authority and the application. If a sentence could appear in a news report, it probably belongs in the facts section rather than
