1. What is Law? |
Law is a system of rules created and enforced by the state to regulate behaviour. It sets out what people can and cannot do, and it applies to everyone in society. Unlike moral or social rules, legal rules carry official penalties, such as fines, imprisonment or community service.
Legal rules are distinguished by their formality. They are written down in statutes or established through court decisions. When someone breaks the law, they face consequences imposed by the state, not just social disapproval. Breaking a moral rule may make you unpopular; breaking a legal rule can lead to a criminal record.
In our society, law is closely linked to concepts of justice, fairness and protecting individual rights. It provides a framework for resolving disputes peacefully rather than through force or revenge. Any valid legal rule normally has five features:
- Authority – it is made by a recognised body such as Parliament or a court.
- Binding force – it applies to everybody, including the government.
- Enforcement – the police, courts and prisons can enforce it.
- Publicity – laws are published so people can know them in advance.
- Changeability – it can only be changed by the proper legal process, not by force.
2. Why We Need Law |
Without law, society would depend on individual strength, wealth or fear. Law exists to keep order, to protect people from harm, and to make sure that disagreements can be settled in a fair and predictable way. It also protects the weakest members of society, such as children, the elderly and people with disabilities.
Law also supports everyday life. Contracts, employment, buying and selling, renting a home and using the internet all depend on legal rules. Businesses are more likely to invest when they know their property and agreements will be protected by the courts.
Finally, law limits the power of government. Ministers and officials can only act within the powers that the law gives them. If they go beyond those powers, the courts can declare their actions unlawful. This is one of the most important functions of law in a democracy.
3. The Rule of Law | 法治
The rule of law is a fundamental principle of the UK constitution. It means that no one is above the law – not even the government or members of Parliament. Everyone must obey the law, and the law should be applied equally and fairly.
The rule of law requires that laws are clear, publicly available and enforced by independent courts. It also protects citizens from arbitrary decisions by the state. People should not be punished except for a proven breach of the law, and they should be able to challenge the state in a court if their rights are ignored.
The classic statement of the rule of law comes from the Victorian lawyer A. V. Dicey, who argued three things:
- No one can be punished unless they have broken a law proved in court.
- Everyone is equal before the law, whatever their wealth or position.
- The rights of individuals are protected by the ordinary courts.
In practice the rule of law depends on three things working together: the legislature (Parliament, which makes law), the executive (government, which applies law) and the judiciary (judges, who interpret law). Keeping these separate is called the separation of powers.
4. Sources of Law in the UK |
UK law comes from several sources, and you should be able to name the main ones and give an example of each. The most important modern source is legislation – Acts of Parliament, also called statutes.
Common law, or case law, is the second major source. It is built up from decisions made by judges in previous cases. Under the doctrine of precedent, a decision of a higher court normally binds lower courts in similar future cases, which is why the reasoning in a judgment matters so much.
Other sources include:
- Delegated legislation – rules made by ministers, councils or other bodies under powers given by an Act of Parliament.
- Human rights law – the Human Rights Act 1998 brings the European Convention on Human Rights into domestic law and requires public bodies to respect it.
- European Union law – historically a source of UK law; its influence has changed since the UK left the EU, but some retained rules still apply.
- Northern Ireland legislation – the Northern Ireland Assembly can make laws on transferred matters, which then apply in Northern Ireland.
When sources conflict, the hierarchy matters. An Act of Parliament beats delegated legislation, and legislation normally beats case law because Parliament is sovereign.
5. Criminal Law | 刑法
Criminal law deals with conduct that is forbidden because it harms society as a whole. Offences range from theft, assault and criminal damage to more serious crimes such as robbery or murder. In criminal cases the state takes action against the accused.
In England and Wales the prosecution is usually brought by the Crown Prosecution Service (CPS); in Northern Ireland it is the Public Prosecution Service (PPS). The accused is presumed innocent until proven guilty, and the prosecution must prove its case to a very high standard.
Standard of proof (criminal): beyond reasonable doubt
If the accused is convicted, the court imposes a sentence. The main aims of sentencing are punishment, deterrence, rehabilitation, protection of the public and reparation to victims. Possible outcomes include a discharge, a fine, a community sentence or imprisonment.
Remember the key vocabulary: actus reus (the guilty act) and mens rea (the guilty mind). For most serious offences the prosecution must prove both.
请记住关键术语:actus reus(犯罪行为)和 mens rea(犯罪意图)。
6. Civil Law | 民法
Civil law deals with disputes between individuals, businesses or organisations. The person who brings the case is the claimant, and the person being sued is the defendant. The aim is not to punish but to put things right, usually by ordering compensation.
Common examples of civil cases include negligence claims after an accident, disputes between landlords and tenants, unpaid debts, family matters such as divorce, and disagreements over contracts. Employment tribunals deal with many workplace disputes.
Standard of proof (civil): on the balance of probabilities
If the claimant wins, the court can order remedies. The most common is damages, a sum of money paid as compensation. The court may also grant an injunction to stop someone doing something, or order specific performance, which requires a party to carry out a contract.
Notice that the same event can lead to both types of case. A dangerous driver may be prosecuted by the state for a criminal offence and also be sued by the injured person for compensation.
7. Criminal vs Civil Law: Key Differences |
Examiners often ask you to compare criminal and civil law directly, so learn the differences as a set of clear contrasts. Use the table below as a memory aid, then practise writing the differences in your own sentences.
|---|---|---|
| Purpose / 目的 | Punish and deter harmful behaviour / 惩罚并威慑危害行为 | Compensate and resolve disputes / 赔偿并解决争议 |
| Who starts the case / 谁起诉 | The state (CPS or PPS) / 国家(CPS 或 PPS) | The claimant (a private party) / 原告(私人一方) |
| Standard of proof / 证明标准 | Beyond reasonable doubt / 排除合理怀疑 | Balance of probabilities / 盖然性权衡 |
| Outcome / 结果 | Conviction and sentence / 定罪与判刑 | Liability and a remedy / 责任与救济 |
Another way to remember it is this: criminal law asks "Has a wrong been done to society?", while civil law asks "Who should pay for the harm caused?"
8. Courts and Appeals |
The court system is arranged in a hierarchy. Lower courts hear the great majority of cases, while higher courts hear the most serious matters and appeals. This structure exists so that decisions are consistent and mistakes can be corrected.
In Northern Ireland, criminal cases normally begin in the Magistrates' Court, where a district judge or lay magistrates deal with less serious offences. Serious cases are sent to the Crown Court, where a judge sits with a jury of twelve people. Civil cases usually begin in the County Court, with more complex or valuable claims going to the High Court.
Above these courts sits the Court of Appeal, and at the very top is the Supreme Court of the United Kingdom, which was established in 2009. Appeals move upwards, and permission is often needed before an appeal can be heard.
Young people have separate arrangements. In Northern Ireland, most cases involving under-18s are heard in a Youth Court, and there is a strong emphasis on restorative justice, including youth conferences that bring the young person together with the victim.
9. People in the Legal System |
Many different people keep the legal system running. Knowing who does what helps you answer questions about the roles of professionals and lay people.
- Police investigate offences, gather evidence and may arrest suspects.
- Solicitors advise clients, prepare cases and often represent them in lower courts.
- Barristers are specialists who present arguments in the higher courts.
- Judges decide questions of law, control the trial and, in serious cases, pass sentence.
- Magistrates are unpaid lay members of the community who sit in the lower courts.
- Juries decide whether the accused is guilty or not guilty in serious criminal trials.
- Court clerks and ushers manage paperwork, keep records and help the court run smoothly.
Lay people matter because they involve ordinary citizens in the administration of justice, which keeps the system connected to the community and, in theory, makes it more open and trusted.
10. Rights, Responsibilities and Human Rights |
Rights and responsibilities go together. If you have the right to free speech, you also have the responsibility to use it without inciting hatred or violence. If you have the right to a fair trial, you have the responsibility to respect the outcomes of the courts.
The Human Rights Act 1998 sets out key rights for everyone in the UK, including the right to life, the right to a fair trial, respect for private and family life, freedom of thought and religion, and freedom of expression. Public bodies such as the police, councils and schools must act in a way that is compatible with these rights.
All rights come with limits. Freedom of expression does not protect threats, defamation or hate speech, and the right to private life can be restricted where it is necessary to prevent crime or protect others. Courts often have to balance competing rights against each other.
11. Law and Young People in Northern Ireland |
Law affects young people in everyday ways, and this is a popular area for exam questions. In Northern Ireland the age of criminal responsibility is ten, which means a child of ten or over can be held responsible for a criminal offence, although the youth justice system works very differently from the adult one.
Children under ten cannot be charged with a crime. For those between ten and seventeen, cases normally go to a Youth Court, and the emphasis is placed on rehabilitation and restorative justice rather than punishment alone. A youth conference can agree a plan that includes an apology, reparation or unpaid work.
Many everyday laws are based on age limits that you should know:
- 10 – age of criminal
