1. The Fundamental Equation of Crime: Actus Reus + Mens Rea |
To secure a conviction for most criminal offences, the prosecution must prove two essential elements beyond reasonable doubt. The physical element is called the actus reus (Latin for 'guilty act'), which can be an action, a failure to act, or a state of affairs. The mental element is the mens rea ('guilty mind'), referring to the defendant's state of mind at the time of the act.
Actus Reus + Mens Rea = Crime
If both elements coincide in time, the defendant is guilty. For example, if Amy strikes Ben (actus reus) with the intention to cause him harm (mens rea), she commits assault. If either element is missing – for instance, if the act was purely accidental and no blameworthy state of mind can be shown – there is usually no criminal liability.
2. The Capacity to Commit a Crime: Age of Criminal Responsibility |
Not every person can form mens rea in the eyes of the law. A crucial 'capacity formula' sets the minimum age at which a child can be prosecuted. In England and Wales, the age of criminal responsibility is 10 years old. Children under 10 are deemed incapable of committing a crime (doli incapax).
This rule is absolute: a child aged 9 cannot be convicted, regardless of how serious the act might be. Between 10 and 17, young offenders are dealt with in the Youth Court, and the focus is often on rehabilitation. Once a person turns 18, they are treated as an adult in the criminal justice system.
3. Strict Liability: Crime Without Mens Rea |
While the formula Actus Reus + Mens Rea is the general rule, some offences require no proof of a guilty mind. These are called strict liability offences. For these crimes, the prosecution only needs to prove the actus reus – that the defendant performed the prohibited act.
Common examples include selling alcohol to a person under 18, speeding, or certain food hygiene offences. Even if the defendant honestly believed the customer was over 18, they are still guilty. Such offences are typically regulatory in nature, aimed at protecting society rather than punishing moral blameworthiness.
4. The Equation of a Tort: Duty + Breach + Damage |
In civil law, a tort is a wrongful act that causes harm to another person. The most common tort is negligence. To establish liability, a claimant must prove three essential ingredients, which can be thought of as a three-part equation.
Duty of Care + Breach of Duty + Damage = Negligence
A duty of care arises when a relationship of proximity exists and it is foreseeable that one's actions could harm another. A breach occurs when the defendant falls below the standard of a reasonable person. Finally, the damage must be caused by the breach (causation) and must not be too remote. If any element fails, the claim in negligence will not succeed.
5. Negligence in Detail: The Three-Stage Test |
Courts use a more detailed framework to decide whether a duty of care exists in a new situation. This is often called the Caparo test, after the leading case. The three stages are foreseeability, proximity, and whether it is fair, just and reasonable to impose a duty.
Once a duty is established, breach is measured against the 'reasonable man' standard. This objective test asks: would a reasonable person in the defendant's position have acted differently? If yes, a breach is likely. Finally, the claimant must show that the breach caused the damage both in fact (the 'but for' test) and in law (the damage must not be too remote a consequence).
6. Elements of a Valid Contract: Offer + Acceptance + Consideration + Intention |
Contract law underpins almost every commercial transaction. For a contract to be legally binding, four key elements must be present. This can be remembered as a simple sum.
Offer + Acceptance + Consideration + Intention to Create Legal Relations = Contract
An offer is a clear statement of terms on which the offeror is willing to be bound. Acceptance must mirror the offer exactly (the mirror image rule). Consideration is something of value exchanged between the parties – each must give something. Finally, both parties must intend the agreement to be legally enforceable; social or domestic arrangements usually lack this intention, while commercial agreements carry a strong presumption of it.
7. Consent as a Defence in Criminal and Tort Law |
Consent can operate as a vital 'cancelling term' in the liability equation. In criminal law, genuine consent can sometimes negate the actus reus or provide a complete defence. For example, in a sports match, a rugby player consents to a degree of physical contact that would otherwise be a battery.
However, consent is not a defence to serious harm or death; one cannot consent to being murdered. In tort law, a claimant who voluntarily assumes a risk (volenti non fit injuria – 'to a willing person, no injury is done') may be barred from claiming. The defendant must show the claimant had full knowledge of the risk and freely accepted it.
8. The 'Eggshell Skull' Rule in Tort |
This is a famous principle of causation in tort law. It states that a defendant must take their victim as they find them. If the claimant has an unusual physical or psychological vulnerability that makes the injury more severe than expected, the defendant is still liable for all the consequences.
The name comes from a hypothetical claimant with an unusually thin skull. If a defendant negligently bumps the claimant's head, and the claimant dies because of the thin skull, the defendant is liable for the death, even though a normal person would have suffered only a minor bump. The 'eggshell skull' rule ensures victims are compensated for the actual harm caused.
9. The Separation of Powers: A Constitutional Formula |
The UK constitution relies on a theory of separated powers to prevent tyranny. The three branches of state – the legislature (Parliament), the executive (Government), and the judiciary (courts) – should each exercise distinct functions and check one another. This can be seen as a constitutional equilibrium.
Parliament makes the law (statutes), the executive implements and enforces the law, and the judiciary interprets the law and adjudicates disputes. A clear overlap, such as government ministers also being MPs, shows the UK's 'fusion' of powers, but judicial independence remains a cornerstone. The principle of the rule of law binds all arms of the state.
10. The Rule of Law: The Ultimate Legal Principle |
The rule of law is the overarching theorem that no one is above the law. It requires that laws are clear, publicised, applied equally, and adjudicated by an independent judiciary. Think of it as the foundation on which every other legal formula is built.
Key aspects include: access to justice, proper legal procedures, and the protection of fundamental rights. The courts can review the lawfulness of decisions made by public bodies through judicial review. If a minister acts beyond their legal powers (ultra vires), the court can quash the decision, reinforcing the rule of law.
11. Mens Rea Levels: Intention, Recklessness, Negligence |
Mens rea is not a single concept but a ladder of fault levels. The highest level is intention, where the defendant's aim or purpose is to bring about the prohibited result. Direct intent means it was their goal; oblique intent means the result was a virtually certain consequence of their actions, and they appreciated that.
Below intention is recklessness: the defendant foresaw a risk of the prohibited outcome occurring but unreasonably went on to take that risk. The test is subjective – what did the defendant actually foresee? The lowest level is negligence, where the defendant fails to meet a reasonable standard of care, even if they did not foresee the risk. In criminal law, gross negligence can lead to manslaughter.
12. Defences: Duress and Necessity |
Even when the formula for a crime is satisfied, a defendant may be able to raise a defence that cancels liability. Duress and necessity are two such 'exception clauses'. Duress applies when the defendant is forced to commit a crime because of a threat of death or serious injury to themselves or others.
The threat must be immediate, and the defendant must have had no reasonable opportunity to escape. Duress is not available for murder or certain treason offences. Necessity is a rare defence that applies where the defendant was forced to choose between two evils – for example, breaking a window to escape a fire. The courts recognise this defence sparingly, requiring that the act done was proportionate to the harm avoided.
