📚 Common Misconceptions and Correction Methods in AS CAIE Law | AS CAIE
Many AS Law students lose marks not because they lack knowledge, but because they repeatedly fall into the same conceptual traps. They can quote Donoghue v Stevenson, list the rules of statutory interpretation and define mens rea, yet still slip from a Grade A to a Grade C because their understanding contains small but systematic distortions. This article identifies the most common misunderstandings across the CAIE AS Law syllabus, explains why each one arises, and gives a practical correction method you can apply in your next revision session and in the exam itself.
1. Confusing Ratio Decidendi and Obiter Dicta |
The common misconception is that everything a judge says in a judgment carries binding force. In reality, only the ratio decidendi (the legal reason for the decision) is binding on lower courts under the doctrine of precedent, while obiter dicta (remarks made 'by the way') are merely persuasive. Students often mistake an obiter statement for a ratio, especially when the remark appears central to the judge's reasoning or is expressed in confident, general language.
A second, subtler error is choosing the wrong level of abstraction. The ratio is not a general moral slogan; it is the legal principle that was necessary on the material facts to reach the decision. If you state the ratio too widely, it will not match the facts of the later case; if you state it too narrowly, it becomes useless as authority. Examiners reward precision, not generosity.
|---|---|---|
| Binding force / 约束力 | Binding on lower courts / 对下级法院有约束力 | Persuasive only / 仅具说服力 |
| Test / 判断标准 | Material facts test / 关键事实检验法 | Not necessary to the decision / 对判决并非必需 |
| Future status / 未来地位 | Can be distinguished, overruled or reversed / 可被区分、推翻或撤销 | May later be adopted as ratio / 日后可能被采纳为判决理由 |
Correction: to identify the ratio, apply the material facts test - ask which legal principle was necessary to decide the case. For example, in Donoghue v Stevenson, you can state the narrow ratio (a manufacturer owes a duty of care to the ultimate consumer where the product is sealed and there is no reasonable opportunity for intermediate inspection) or the wide ratio (the neighbour principle, that we owe a duty to those we can reasonably foresee will be affected by our acts). Both are defensible; what is not defensible is quoting every sentence about product liability as if it were binding. Obiter dicta can later become ratio if a court adopts them, but until that happens they are not binding.
2. Misusing Stare Decisis: Overruling Is Not Reversing |
The misconception is that any higher court decision that changes an earlier outcome is an example of overruling. In fact, overruling occurs when a court in a later, different case declares the legal rule laid down in an earlier case to be wrong; reversing occurs when an appellate court changes the decision of a lower court in the same case. Using the two words interchangeably is one of the fastest ways to lose marks in a legal system question.
eclared wrong = overruling. Where a court avoids a precedent because the material facts are different, that is distinguishing, not overruling. Where a lower court refuses to follow a precedent it considers wrong, that is not overruling either, because the lower court lacks that power.
Also remember that precedent is only binding where the court hierarchy and the direction of the ruling permit it: a decision of a higher court binds lower courts, and appellate courts are generally bound by their own previous decisions subject to recognised exceptions. The Privy Council, for example, is persuasive rather than strictly binding on English courts, and decisions of foreign courts are persuasive only.
3. Distinguishing: A Skill, Not an Escape Route |
Students often believe that any factual difference allows a court to distinguish a precedent, so a case can always be avoided. That is wrong. Distinguishing works only when the difference is material - that is, when the difference is relevant to the legal principle being applied. A difference in the colour of a car is not material; a difference in whether the victim consented may be.
Correction: practise writing distinctions in this form: 'This case can be distinguished because the material fact of X was present in the earlier case but is absent here, and X was essential to the ratio.' If you cannot identify which part of the ratio depends on that fact, you are not distinguishing; you are simply disagreeing with the result.
4. Criminal and Civil Law: Burden and Standard of Proof |
The misconception is that the claimant proves everything in a civil case and the defendant proves everything in a criminal case. In reality, the legal burden in a criminal trial rests on the prosecution throughout; the defence does not have to prove innocence. In civil proceedings the burden generally rests on the party who asserts the fact, which is usually the claimant, but it can shift or be reversed by statute or by the nature of the issue.
The second misconception concerns the standard of proof. 'Beyond reasonable doubt' does not mean absolute certainty and does not require the elimination of every fanciful possibility; it means the tribunal must be sure. The civil standard, the balance of probabilities, does not mean '51 per cent likely' in a mechanical sense; it means the claimant's version is more likely than not, and the more serious the allegation, the stronger the evidence required.
Correction: in every problem question, state the burden and the standard explicitly in one sentence before applying the law. This single sentence often carries an easy mark and protects you from writing 'the defendant must prove he is innocent', which is a serious conceptual error.
5. Actus Reus: Omissions, State of Affairs and Causation |
The misconception is that criminal liability always requires a positive act. There is no general duty to act in English criminal law, but liability for omission exists in recognised categories: a statutory duty, a contractual duty, a duty arising from a close relationship, a duty assumed voluntarily, a duty arising where the defendant created a dangerous situation, and a duty attaching to a public office. Students who recite 'there is no liability for omission' without qualification will lose marks immediately.
A related error is to treat 'state of affairs' offences as if they required voluntary conduct. In cases such as Larsonneur and Winzar v Chief Constable of Kent, the defendant was convicted although the relevant circumstance was not of his making. These are exceptional; do not use them to generalise that actus reus never requires voluntariness.
Causation attracts the largest number of errors. Factual causation uses the 'but for' test - but for the defendant's act, would the result have occurred? Legal causation asks whether the defendant's act was a substantial and operating cause. A novus actus interveniens breaks the chain, but it must be more than a mere contributing factor: in R v Smith, poor medical treatment did not break the chain, and in R v Cheshire the court confirmed that only in the rarest cases will medical treatment be so independent and potent that the original injury is no longer a significant cause.
Correction: always run the causation analysis in two stages, factual then legal, and separately consider whether an intervening act (of a third party, the victim or a natural event) was free, deliberate and informed. In R v Pagett, the victim's reasonable act of self-preservation did not break the chain because the defendant's own conduct set the sequence in motion.
6. Mens Rea: Intention, Recklessness and Coincidence |
The most damaging misconception here is that the Woollin direction means oblique intention is automatically established whenever a result is virtually certain. It does not. Woollin establishes that where the result was a virtual certainty and the defendant appreciated that it was, the jury may find intention - not that it must. 'May' and 'must' are the difference between a Level 3 and a Level 4 answer.
Recklessness is another trap. In R v Cunningham recklessness is
