1. Criminal Liability Formula |
In criminal law, the basic building blocks of an offence can be summarised in a simple equation. Every crime requires proof of an actus reus (the guilty act) and a mens rea (the guilty mind), unless the offence is one of strict liability. In addition, the absence of a valid defence must be established.
The core liability formula: Actus Reus + Mens Rea - Defence = Criminal Liability.
This formula highlights that the prosecution must prove both the physical and mental elements beyond reasonable doubt. A successful defence—such as self-defence, duress, or insanity—negates liability even where actus reus and mens rea are present.
2. Actus Reus – Voluntary Act and Omissions |
The actus reus of an offence comprises all the external elements, including conduct, any required circumstances, and any prohibited consequences. Crucially, the defendant’s conduct must be voluntary; an involuntary act (e.g., a reflex or an act done while unconscious) does not generally satisfy actus reus.
An omission—a failure to act—can establish actus reus only where the defendant is under a legal duty to act. Duties may arise from statute (e.g., the Road Traffic Act to provide a specimen of breath), a contract (e.g., a lifeguard’s duty), a special relationship (e.g., parent and child), a voluntary assumption of responsibility, or a creation of a dangerous situation.
The formula for actus reus in omission cases: Legal Duty + Failure to Act = Actus Reus by Omission.
3. Mens Rea – Intention and Recklessness |
Mens rea describes the mental element required for a particular offence. The two principal forms of mens rea in AS OCR Law are intention and recklessness. Direct intention exists where the defendant aims to bring about a prohibited consequence. Oblique intention applies where the consequence is a virtual certainty of the defendant’s actions, and the defendant appreciates this (as in Woollin).
Recklessness involves the conscious taking of an unjustified risk. The test is subjective (Cunningham recklessness): the defendant must have foreseen the risk of a prohibited consequence occurring and nonetheless gone on to take that risk. If the defendant did not foresee the risk, they are not reckless under this test.
Key mens rea equation: Direct Intention + Oblique Intention + Recklessness = Major Forms of Mens Rea.
4. Causation – Factual and Legal |
Where the actus reus requires a consequence (e.g., death in murder, wounding in GBH), the prosecution must prove that the defendant’s act caused that consequence. Causation is established through two tests: factual causation (the 'but for' test) and legal causation (the 'operating and substantial' cause test).
Factual causation asks: But for the defendant’s conduct, would the result still have occurred? If the answer is no, factual causation is satisfied. Legal causation then requires that the defendant’s act be an operating and substantial cause of the consequence; it need not be the sole cause. An intervening act (novus actus interveniens) may break the chain of causation only if it is free, deliberate, and informed, or if it is an unforeseeable natural event.
Causation formula: Factual 'But For' + Legal 'Operating and Substantial' = Causation.
5. Strict Liability |
Strict liability offences require proof only of the actus reus; no mens rea is needed. These are primarily regulatory or quasi-criminal offences where the law imposes absolute liability to protect the public, such as selling food beyond its use-by date or driving without insurance.
The classic test for determining whether an offence is of strict liability comes from Gammon (Hong Kong) Ltd v Attorney-General. The presumption is that mens rea is required, but this can be displaced if the statute clearly indicates otherwise, the offence is regulatory in nature, or the issue is of social concern. The absence of any wording such as 'knowingly' or 'recklessly' often points toward strict liability.
Strict liability equation: Actus Reus + No Need for Mens Rea = Strict Liability Offence.
6. Assault and Battery |
Assault and battery are two distinct common-law non-fatal offences. Assault is committed when the defendant intentionally or recklessly causes the victim to apprehend immediate unlawful force. No physical contact is required; words alone, or even silence in some circumstances, can suffice.
Battery is the actual infliction of unlawful force upon another, committed intentionally or recklessly. The slightest touching, without consent, can amount to a battery. Everyday jostlings are generally excluded under the doctrine of implied consent.
Assault and battery formulae: Intent/Recklessness + Apprehension of Immediate Force = Assault; Intent/Recklessness + Application of Unlawful Force = Battery.
7. Offences Against the Person – s.47, s.20, s.18 |
The Offences Against the Person Act 1861 sets out the three main non-fatal offences: s.47 assault occasioning actual bodily harm (ABH), s.20 malicious wounding or inflicting grievous bodily harm (GBH), and s.18 wounding or causing GBH with intent. Each offence has a distinct formula.
Section 47: Assault or Battery + Actual Bodily Harm = ABH. The mens rea is the same as for the underlying assault or battery; no additional intention or recklessness as to the harm is required.
Section 20: Wounding or Inflicting GBH + Malice (intention/recklessness as to some harm) = s.20 GBH. 'Maliciously' means intention or subjective recklessness about some harm, not necessarily serious harm.
Section 18: ng GBH + Specific Intent (to cause GBH or to resist/prevent arrest) = s.18 GBH with intent. This is a specific intent offence carrying a maximum sentence of life imprisonment.
8. Theft – Definition and Elements |
Under s.1 of the Theft Act 1968, a person is guilty of theft if they dishonestly appropriate property belonging to another with the intention of permanently depriving the other of it. The offence is distilled into its five key elements: appropriation, property, belonging to another, dishonesty, and intention to permanently deprive.
The theft formula: + Property + Belonging to Another + Dishonesty + Intention to Permanently Deprive = Theft.
Dishonesty is partially defined in s.2, which identifies three situations in which a defendant is not dishonest (e.g., belief in a legal right to deprive), but the current common law test for dishonesty in theft is the modified Ivey v Genting Casinos test: first, ascertain the defendant’s actual knowledge and belief; second, determine whether the conduct was dishonest by the standards of ordinary decent people.
9. Negligence – Duty, Breach, Damage |
The tort of negligence is the most common tort on the AS OCR syllabus. Its three-part structure operates like a formula: Duty of Care + Breach of Duty + Damage (causation and remoteness) = Negligence.
Duty of care is established using the three-part Caparo v Dickman test: (1) foreseeability of harm, (2) proximity between the parties, and (3) it is fair, just and reasonable to impose a duty. In novel situations, the courts apply incremental reasoning by analogy with existing precedents.
Breach occurs where the defendant’s conduct falls below the standard of the reasonable man. Courts weigh factors such as the likelihood and seriousness of harm, the cost of taking precautions, and the social utility of the defendant’s activity. The reasonable man does not make allowances for inexperience, but special standards apply to children and professionals.
Damage is proved via factual causation (the 'but for' test) and legal causation (no novus actus interveniens). Remoteness of damage, governed by the Wagon Mound principle, limits liability to damage of a type that was reasonably foreseeable.
10. Judicial Precedent |
The doctrine of judicial precedent (stare decisis) is a fundamental principle of the English legal system. It can be expressed as Ratio Decidendi + Court Hierarchy = Binding Precedent. The ratio decidendi is the legal reason for a decision, and it binds future courts that are lower in, or at the same level as, the court that made the decision.
Only the ratio is binding; obiter dicta (statements made 'by the way') are merely persuasive. The Supreme Court (formerly the House of Lords) is the highest appellate court, followed by the Court of Appeal, the High Court, and then inferior courts. The Supreme Court is generally bound by its own previous decisions, but may depart from them under the 1966 Practice Statement when it appears right to do so.
The Court of Appeal’s civil division is bound by its own decisions and those of the Supreme Court, subject to limited exceptions in Young v Bristol Aeroplane Co Ltd. The High Court is bound by all appellate courts above it but generally not by its own decisions at first instance.
Precedent efficiency formula: Ratio + Obiter (Persuasive) + Flexible Departure Mechanisms = Adaptive Legal System.
