1. The Nature and Classification of Law |
Law is a system of rules created and enforced by the state to regulate conduct, maintain order and deliver justice. It differs from moral rules or social conventions in that breach of law results in formal sanctions such as fines, imprisonment or civil remedies.
One fundamental distinction is between public law and private law. Public law governs the relationship between the individual and the state, covering constitutional law, administrative law and criminal law. Private law, on the other hand, regulates relations between individuals and organisations, and includes contract law, tort law, land law and family law.
Criminal law and civil law are distinguished by their purpose, parties, burdens and outcomes. A criminal case is brought by the state against a defendant accused of an offence punishable by the state; the prosecution must prove guilt beyond reasonable doubt. Civil law resolves disputes between individuals or businesses; the claimant proves the case on the balance of probabilities, and the usual remedy is damages or an injunction.

2. Sources of Law and the Legislative Process |
The two principal sources of English law are Parliament-made statutes (legislation) and judge-made case law (common law and equity). Parliament is sovereign and can pass any law; primary legislation takes the form of an Act of Parliament, while secondary legislation is made by ministers under powers delegated by an Act.
A Bill must pass through several stages in the House of Commons and the House of Lords before receiving Royal Assent. The process includes a first reading (formal introduction), second reading (main debate on principles), committee stage (detailed clause-by-clause examination), report stage (further amendments) and third reading (final vote). The courts then interpret statutes using rules of statutory interpretation: the literal rule, golden rule, mischief rule and purposive approach.
Case law develops through the doctrine of judicial precedent. The hierarchy of courts ensures that decisions of higher courts bind lower courts. The ratio decidendi (reason for the decision) creates a binding precedent, while obiter dicta (comments made by the way) are merely persuasive. The Supreme Court replaced the House of Lords as the highest appeal court in 2009 and can depart from its own earlier decisions when it appears right to do so.
3. The Court System and Legal Personnel |
The court structure in England and Wales distinguishes between criminal courts and civil courts. Magistrates' courts try summary offences and some triable-either-way offences, while the Crown Court deals with indictable offences and appeals from the magistrates. In civil matters, the County Court hears most contract and tort claims of lower value, and the High Court handles more complex cases divided into three divisions: Queen's Bench, Chancery and Family.
Appeals generally progress from first instance courts to the Court of Appeal (Civil or Criminal Division) and finally to the Supreme Court. The UK Supreme Court hears cases that raise a point of law of general public importance and also determines devolution issues.
Legal professionals include solicitors, who mainly advise clients and prepare cases, and barristers, who specialise in advocacy and advising on complex legal issues. Judges are appointed from experienced barristers or solicitors, and they perform a crucial role in ensuring fair trials, interpreting statutes and developing the common law. In the criminal justice system, lay magistrates (justices of the peace) sit with a legal adviser, while juries are used in Crown Court trials to decide facts and return a verdict.
4. General Principles of Criminal Liability |
To establish criminal liability, the prosecution must normally prove two elements: actus reus (the guilty act) and mens rea (the guilty mind), and that there is no valid defence. The actus reus can be a positive act, an omission where a duty exists, or a state of affairs. It must be voluntary, and causation between the defendant's conduct and the harm must be established in result crimes.
Mens rea refers to the mental element required for a particular offence. The highest level is intention (direct or oblique), followed by recklessness (consciously taking an unjustifiable risk) and, for some offences, negligence or knowledge. Some regulatory offences are classified as strict liability, meaning mens rea need not be proved for at least part of the actus reus.
Defences can be general (available to many offences) or specific. Self-defence is a complete defence if the defendant used reasonable force in response to an imminent threat. Intoxication may negate mens rea for specific intent crimes but is rarely a defence for basic intent crimes. The defence of insanity is based on the M'Naghten Rules, requiring a defect of reason from disease of the mind so that the defendant did not know the nature and quality of the act or did not know it was wrong.
5. Offences Against the Person and Property |
Offences against the person are largely contained in the Offences Against the Person Act 1861. Common assault and battery are the least serious: assault is causing the victim to apprehend immediate unlawful violence, while battery is the actual infliction of unlawful force. Both require intention or recklessness. Actual bodily harm (ABH) under section 47 occurs when common assault or battery causes 'some harm' that is more than trivial. Grievous bodily harm (GBH) under section 20 requires a wound or really serious harm, with mens rea of some foresight of harm. Section 18 GBH with intent is the most serious, requiring specific intent to cause GBH or resist arrest.
Property offences centre on the Theft Act 1968. Theft is the dishonest appropriation of property belonging to another with the intention of permanently depriving the other of it. Robbery is theft accompanied by the use or threat of force. Burglary involves entering a building as a trespasser with intent to commit theft, GBH or unlawful damage. Criminal damage under the Criminal Damage Act 1971 criminalises destroying or damaging property belonging to another without lawful excuse, whether intentionally or recklessly.
6. The Law of Tort: Negligence and Nuisance |
The tort of negligence is the most common civil wrong. To succeed in a negligence claim, the claimant must prove that the defendant owed a duty of care, breached that duty and caused the claimant recoverable loss. The neighbour principle from Donoghue v Stevenson establishes a duty to take reasonable care for those who may foreseeably be affected by one's actions. The modern Caparo three-part test asks whether harm was foreseeable, whether there was proximity between the parties, and whether it is fair, just and reasonable to impose a duty.
Breach of duty occurs when the defendant falls below the standard of the reasonable person. Factors considered include the magnitude of the risk, the seriousness of potential harm, the practicality of precautions and any social value of the conduct. Causation requires both factual causation (the 'but for' test) and legal causation, meaning the damage must not be too remote. The damage must be of a type that was reasonably foreseeable (The Wagon Mound). Defences include contributory negligence (damages reduced) and consent (volenti non fit injuria).
Private nuisance is an unlawful interference with a person's use or enjoyment of land. It typically involves noise, smells, smoke or other emissions. Claimants must have a legal interest in the land, and the interference must be both substantial and unreasonable. The court balances the competing interests of neighbours, considering factors such as locality, duration, sensitivity of the claimant and malice. Remedies are usually damages or an injunction to stop the nuisance.
7. Contract Law: Formation and Remedies |
A legally binding contract is formed when there is an offer, an acceptance, consideration, an intention to create legal relations and sufficient certainty of terms. An offer is a definite promise to be bound on specific terms, as distinct from an invitation to treat, which is merely an invitation to negotiate (e.g. goods on display in a shop). Acceptance must be an unqualified agreement communicated to the offeror, and the postal rule may apply where acceptance by post takes effect on posting.
Consideration is something of value exchanged between the parties. It must be sufficient but need not be adequate, meaning courts will not enquire into economic fairness as long as there is some legal value. Past consideration is generally insufficient, and performance of an existing public duty or a contractual duty owed to the same promisor does not normally amount to valid consideration unless practical benefit is provided.
When a contractual term is broken, the innocent party can seek remedies. Damages aim to put the claimant in the position they would have been in had the contract been performed, subject to the rules on remoteness and mitigation. Equitable remedies such as specific performance compel a party to perform contractual obligations, typically where damages would be inadequate. An injunction may be granted to restrain a breach. The court may also allow rescission for misrepresentation or refuse to enforce an unfair exclusion clause under the Unfair Contract Terms Act 1977 and the Consumer Rights Act 2015.
8. Legal Reform and Evaluation |
Law must adapt to social, technological and economic change. The permanent body for law reform in England and Wales is the Law Commission, established by the Law Commissions Act 1965. Its role is to review areas of law, codify the law where appropriate, repeal outdated statutes and make recommendations to Parliament. Many of its proposals have been enacted, such as the Coroners and Justice Act 2009. However, government acceptance of reports can be slow, and some reforms languish for years without legislative time.
When evaluating any area of law, candidates should consider fairness (are rules just and treat parties equally?), clarity (is the law easy to understand and accessible?), consistency (do similar cases produce similar outcomes?) and effectiveness (does the law achieve its purposes and protect rights?). Other relevant criteria include accessibility of justice in terms of cost and delay, and the balance between competing interests such as freedom and security, or claimant protection and defendant liability.
