📚 GCSE OCR Law: Formula & Principle Quick Reference Handbook | GCSE OCR

Welcome to your essential GCSE OCR Law quick‑reference handbook. Just as maths uses equations, law relies on formulas of liability, tests of guilt, and structured principles. This guide translates key legal rules into memorable 'formulas' and 'theorems' to help you analyse scenarios with precision and secure top marks. Each section pairs a core equation with clear English explanation, followed immediately by its Chinese counterpart.

1. The Criminal Liability Equation |

Actus Reus + Mens Rea – Defence = Criminal Liability

For a defendant to be found guilty of a criminal offence, the prosecution must prove two fundamental elements beyond reasonable doubt: an actus reus (the guilty act) and a mens rea (the guilty mind). These must coincide in time. If a valid defence, such as self-defence or insanity, applies, liability is negated even where the act and mental element are present.

Actus reus can take three forms: a voluntary affirmative act; an omission where a legal duty to act exists (such as a contractual duty, a duty arising from a special relationship, or a duty created by the defendant's own dangerous act); or a 'state of affairs' offence, where the mere fact of being in a certain situation constitutes the actus reus.

Mens rea varies by offence. The highest level is intention (direct or oblique), followed by recklessness (subjective awareness of a risk and unreasonably taking it), negligence, and strict liability (where no mens rea is required). The formula must be tailored to each specific offence definition.

2. Causation: The Two-Stage Test |

Factual Causation ('But For' Test) + Legal Causation (Substantial & Operative) = Causation Established

In result crimes such as murder or manslaughter, the prosecution must prove that the defendant's conduct caused the prohibited outcome. Causation involves two limbs. First, factual causation: applying the 'but for' test from White, would the harm have occurred but for the defendant's act? If no, the act is a factual cause.

Second, legal causation: the defendant's act must be a substantial and operative cause of the harm, as in Smith. It need not be the sole cause. A novus actus interveniens (intervening act) can break the chain of causation only if it is free, voluntary and informed, or so overwhelming as to render the original act merely part of the background. Medical negligence rarely breaks the chain (Cheshire).

The 'thin skull' rule (Blaue) provides that the defendant must take the victim as found. Pre-existing conditions or beliefs that aggravate the harm do not break causation.

3. Non-Fatal Offences: The Hierarchy |

Assault → Battery → ABH (s.47) → GBH (s.20) → GBH with Intent (s.18)

The Offences Against the Person Act 1861 creates a ladder of liability. For each rung, both actus reus and mens rea must be satisfied. The table below sets out the essential components.

Causing the victim to apprehend immediate unlawful forceIntention or recklessness as to causing such apprehension
Battery / 殴打Infliction of unlawful force on anotherIntention or recklessness as to the application of force
Assault or battery causing actual bodily harm (more than trivial)Intention or recklessness as to the assault or battery (Roberts)
Wounding or inflicting grievous bodily harm'Maliciously' – intention or recklessness as to some harm (Mowatt)
Wounding or causing grievous bodily harmSpecific intent to cause GBH or resist/prevent lawful arrest

The hierarchy matters: a more serious offence may be charged where the harm and mental element escalate. Consent operates as a defence in some contexts (e.g., sports, surgery), but cannot generally be given to actual bodily harm or above unless the activity falls within a recognised public interest exception.

4. Murder and Partial Defences |

Unlawful Killing + Malice Aforethought = Murder

Murder is established where the defendant unlawfully causes the death of a reasonable person under the Queen's Peace, with malice aforethought. Malice aforethought means an intention to kill or an intention to cause really serious bodily harm (GBH). This can be direct intent (purpose) or oblique intent (the virtual certainty test from Woollin).

If a defendant satisfies the definition of murder but can raise a partial defence, the conviction is reduced to voluntary manslaughter. The two key partial defences under the Coroners and Justice Act 2009 are diminished responsibility and loss of control.

Murder + Diminished Responsibility = Voluntary Manslaughter

Under s.2 Homicide Act 1957 as amended, diminished responsibility requires an abnormality of mental functioning arising from a recognised medical condition, which substantially impaired the defendant's ability to understand the nature of their conduct, form a rational judgement, or exercise self-control, and which provides an explanation for the killing.

Murder + Loss of Control = Voluntary Manslaughter

Loss of control, defined in ss.54-55 CJA 2009, requires: (a) the defendant's acts resulted from a loss of self-control; (b) the loss of self-control had a qualifying trigger (fear of serious violence, or things said/done which constituted circumstances of an extremely grave character and caused a justifiable sense of being seriously wronged, or a combination); and (c) a person of the defendant's sex and age, with a normal degree of tolerance and self-restraint, might have reacted in the same or similar way.

5. Unlawful Act Manslaughter (Constructive Manslaughter) |

Unlawful Act + Dangerousness + Causation = Unlawful Act Manslaughter

This involuntary manslaughter formula does not require an intention to kill or cause GBH. The prosecution must prove a base crime (the unlawful act) that is criminal in nature, not merely civil wrong. The act must be objectively dangerous: a sober and reasonable person would recognise the risk of some harm (Church). The act must cause death. The mens rea is whatever mental element the base crime requires; there is no separate MR for the resulting death.

Common examples of the unlawful act include assault, battery, ABH, or the supply of drugs where the chain of causation remains intact. If the drug is self-administered by a fully informed adult, the chain may be broken (Kennedy).

Gross negligence manslaughter is an alternative pathway, requiring a duty of care, a breach of that duty, a risk of death, gross negligence that is so bad as to amount to a crime, and causation of death. Its formula is distinct and does not rely on an unlawful act.

6. Theft Act 1968: The Five-Part Formula |

+ Property + Belonging to Another + Dishonesty + Intention to Permanently Deprive = Theft

Section 1 Theft Act 1968 provides a compendious definition. All five elements must exist simultaneously. 'Appropriation' (s.3) means any assumption of the rights of an owner; even an innocent assumption followed by a later dishonest decision can amount to appropriation (Gomez, Hinks). 'Property' (s.4) includes money, real property, personal property, things in action and other intangible property, but generally excludes wild plants and confidential information.

'Belonging to another' (s.5) is widely defined: the property must belong to someone other than the defendant at the moment of appropriation. Where a person receives property under an obligation to deal with it in a particular way, that property is treated as belonging to another. 'Dishonesty' is not fully defined in the Act. The Ghosh test (now modified by Ivey v Genting Casinos) asks: (1) what was the defendant's genuine state of knowledge or belief as to the facts? (2) was the defendant's conduct dishonest by the objective standards of ordinary decent people? 'Intention to permanently deprive' (s.6) includes treating the property as one's own to dispose of regardless of the owner's rights, even if the property is later returned.

7. The Tort of Negligence Formula |

Duty of Care + Breach of Duty + Damage (Causation + Remoteness) – Defences = Liability in Negligence

To succeed in a negligence claim, the claimant must first establish that the defendant owed them a duty of care. The modern test derives from Caparo v Dickman: (a) was the harm reasonably foreseeable? (b) was there a relationship of proximity? (c) is it fair, just and reasonable to impose a duty? The neighbour principle from Donoghue v Stevenson remains the starting point: you must take reasonable care to avoid acts or omissions which you can reasonably foresee would be likely to injure your neighbour.

Breach occurs when the defendant falls below the standard of the reasonable person in the circumstances. The court considers factors such as the likelihood of harm, the seriousness of potential injury, the cost and practicability of precautions, and any social utility of the defendant's activity. Professional defendants are judged by the standard of an ordinary competent professional of that field (Bolam test, modified by Montgomery for medical disclosure).

For damage, the claimant must prove causation (both factual 'but for' and legal) and that the damage is not too remote. The Wagon Mound No.1 test for remoteness: damage of a type that was reasonably foreseeable is recoverable; the extent need not be foreseeable (thin skull rule also applies in tort).

8. Occupiers' Liability: The Two-Tier Formula |

Occupier + Premises + Visitor/Trespasser + Breach of Duty = Liability

Occupiers' liability is governed by two statutes depending on the status of the entrant. The Occupiers' Liability Act 1957 covers lawful visitors; the Occupiers' Liability Act 1984 limits the duty owed to trespassers.

Under the 1957 Act, an occupier owes a 'common duty of care' to all lawful visitors, requiring such care as is reasonable to see that the visitor will be reasonably safe in using the premises for the purposes for which they are invited or permitted. The occupier must be prepared for children to be less careful than adults; a person exercising a calling must appreciate and guard against special risks. Warnings and independent contractors may discharge the duty if reasonable.

The 1984 Act imposes a more limited duty in respect of trespassers. An occupier owes a duty only if: (a) they are aware of the danger or have reasonable grounds to believe it exists; (b) they know or have reasonable grounds to believe that a trespasser is in, or may come into, the vicinity of the danger; and (c) the risk is one against which, in all the circumstances, they may reasonably be expected to offer some protection. The duty is to take such care as is reasonable in all the circumstances to see that the trespasser does not suffer injury on the premises by reason of the danger concerned.

9. Human Rights: The Qualified Rights Equation |

Convention Right + Interference – Justification = Proven Violation

The European Convention on Human Rights, incorporated by the Human Rights Act 1998, distinguishes between absolute rights (such as Article 3's prohibition of torture, which cannot be derogated from) and qualified rights. Qualified rights, such as Article 8 (private and family life), Article 10 (freedom of expression) and Article 11 (freedom of assembly), may be lawfully interfered with only if three conditions are met.

The three-part test: any interference must be (i) 'in accordance with the law' – it must have a clear legal basis, accessible and foreseeable; (ii) in pursuit of a 'legitimate aim' listed in the Article itself, such as national security, public safety, prevention of disorder or crime, protection of health or morals, or protection of the rights and freedoms of others; and (iii) 'necessary in a democratic society' – a pressing social need, and proportionate to the aim pursued. Proportionality requires that a fair balance be struck between the individual's rights and the general interest.
