1. Statutory Interpretation: The Three Rules |

The literal rule, golden rule, and mischief rule are perennial favourites in CCEA A2 Law exams. Candidates are often asked to apply these rules to a hypothetical statute or to discuss their advantages and disadvantages. A common mistake is confusing the narrow golden rule with the wider purposive approach. The narrow golden rule is used only where the literal meaning produces an absurdity, yet students sometimes present it as a general power to correct injustice, which is actually the domain of the mischief rule or the modern purposive approach in Pepper v Hart. Another error is failing to cite key case law precisely. For example, when explaining the literal rule, you must reference R v Judge of the City of London Court (1892) or Fisher v Bell, and when discussing the mischief rule, Smith v Hughes (1960) is essential. Without accurate case facts and ratios, analysis remains vague and cannot earn top marks.

R v Judge of the City of London Court

Students frequently lose marks by misapplying the golden rule in scenarios involving ambiguous words. The golden rule has two variants: the narrow approach, used where words have multiple meanings, and the wider approach, used to avoid a repugnant result. In Re Sigsworth (1935), the wider approach prevented a son who murdered his mother from inheriting her estate, despite clear statutory wording. An easy pitfall is to label this as an application of the mischief rule; it is not, because the court modified the literal meaning to avoid an outcome that Parliament could not have intended. Always identify which limb of the golden rule you are using and justify your choice with the reasoning from the case.

2. Judicial Precedent: Ratio Decidendi and Obiter Dicta |

The doctrine of stare decisis requires a clear understanding of ratio decidendi and obiter dicta. A typical exam question asks you to identify the ratio of a given case or to explain how a later court might treat an obiter statement. The most frequent error is treating the outcome of a case as the ratio. The ratio is the legal principle necessary for the decision, not the verdict itself. For instance, in Donoghue v Stevenson (1932), the ratio is the neighbour principle establishing a duty of care, not simply that Mrs Donoghue won. Many students also struggle to distinguish persuasive obiter dicta from binding ratio. Obiter from the Supreme Court (formerly House of Lords), such as Lord Denning's comments in Central London Property Trust v High Trees House (1947) on promissory estoppel, may be highly persuasive, but they are not binding on lower courts. Confusing these concepts can undermine your entire essay or problem question.

When tackling questions on avoiding precedent, students often mix up distinguishing, overruling, and reversing. Distinguishing occurs when a court finds material factual differences and thus refuses to follow a precedent, leaving it intact. Overruling happens when a higher court in a later case declares a precedent wrong and sets a new rule. Reversing is when the same case proceeds on appeal and the higher court changes the decision. A frequent mistake is stating that the Court of Appeal can overrule its own past decisions; it cannot, except in the limited circumstances identified in Young v Bristol Aeroplane Co Ltd (1944). Only the Supreme Court and, through the Practice Statement 1966, the House of Lords possess the authority to depart from their own previous decisions. Mixing these mechanisms leads to flawed analysis of the court hierarchy.

3. Actus Reus and Causation in Criminal Law |

Actus reus encompasses not only the prohibited act but also any required circumstances and consequences. In result crimes, causation must be proved. Students frequently lose marks by ignoring the two-stage test for causation: factual causation (the 'but for' test from R v White) and legal causation (the operating and substantial cause test from R v Smith). A typical error is applying the 'but for' test and then stopping, without discussing whether the defendant's act was a substantial and operative cause. In R v Cheshire (1991), it was held that even negligent medical treatment would not break the chain of causation unless it was so independent and potent as to render the original wound merely part of the history. Many candidates incorrectly suggest that any medical negligence automatically breaks the chain. This shows a superficial grasp of legal causation.

Omissions are another testing area. Students can accurately recite that there is no general duty to act, but they fail to apply the specific duty situations confidently. The six recognised duties—statutory, contractual, relationship, voluntary assumption of care, creation of a dangerous situation, and public office—must be linked to authority. For instance, a parent starving a child gives rise to liability under the relationship duty (R v Gibbins and Proctor), while a person who accidentally starts a fire and then walks away may be liable under the creation of a dangerous situation duty (R v Miller). Exams often present a scenario with an omission; the candidate who merely states 'there is no liability for omissions' without checking for a duty will miss the issue entirely.

4. Mens Rea: Direct Intention, Oblique Intention, and Recklessness |

Mens rea for most common law crimes requires intention or recklessness. The distinction between direct and oblique intention is notoriously confusing. Direct intention is straightforward: the defendant desires the consequence. Oblique intention applies where the consequence is virtually certain and the defendant appreciates that it is virtually certain (R v Woollin). A persistent mistake is to treat foresight of a high probability as oblique intention. Unless the consequence is virtually certain—barring some unforeseen intervention—the jury is not entitled to find intention. In the exam, students often misapply the Woollin test by focusing on what a reasonable person would have foreseen, rather than what the defendant actually appreciated. This collapses the test into an objective recklessness standard, which is incorrect.

Recklessness in criminal law is largely subjective following R v G (2003). A defendant is reckless if he foresees a risk of the prohibited consequence and, in the circumstances known to him, it is unreasonable to take that risk. The common pitfall is to treat Caldwell recklessness (objective) as still good law for all offences. While it has been overruled for most crimes, remnants of objective recklessness remain in a few areas, such as criminal damage by arson under certain interpretations, but CCEA markers expect you to emphasise the subjective test. In problem questions, state the subjective test, apply the defendant's actual awareness, and then briefly discuss whether the risk taken was unreasonable. Avoid simply concluding that a defendant 'should have known' the risk, as that sounds in negligence, not recklessness.

5. Non-Fatal Offences Against the Person |

The hierarchy of assault, battery, assault occasioning actual bodily harm (ABH) under s.47, malicious wounding or inflicting grievous bodily harm (GBH) under s.20, and wounding or causing GBH with intent under s.18 of the Offences Against the Person Act 1861 demands precise application. A critical error is conflating assault and battery. Assault is causing the victim to apprehend immediate unlawful force (R v Ireland); battery is the actual infliction of unlawful force (Collins v Wilcock). Students frequently write that 'the defendant assaulted the victim by punching', when punching is a battery. Using the terms interchangeably in an essay undermines technical accuracy.

For s.47 ABH, many students forget that the actus reus includes an assault or battery causing 'actual bodily harm', which has been interpreted broadly to include psychiatric injury (R v Chan-Fook). However, emotional distress alone, without a recognised psychiatric condition, does not suffice. A common answer would state that the victim felt traumatised and thus ABH is made out. That misstates the law. Similarly, s.20 requires 'maliciously', meaning intention or recklessness as to some harm, not necessarily serious harm (R v Mowatt). Students often incorrectly assert that s.20 requires intention to cause GBH. That requirement belongs to s.18. Mixing the mens rea of s.20 and s.18 is a frequent and costly mistake.

6. Murder and the Partial Defences to Murder |

Murder is defined as the unlawful killing of a human being under the Queen's Peace with malice aforethought. A typical exam question involves identifying whether the mens rea for murder—intention to kill or cause GBH—is present and then considering the partial defences of diminished responsibility, loss of control, or suicide pact. One trap is failing to distinguish the old defence of provocation from the new loss of control under the Coroners and Justice Act 2009. Provocation had both subjective and objective elements based on a reasonable person sharing the defendant's characteristics. Loss of control now has a two-stage test: the defendant must have lost self-control, and the loss of control must have a qualifying trigger. Many candidates still quote the old law and cases like R v Duffy, losing marks for outdated analysis.

Diminished responsibility under s.2 of the Homicide Act 1957 as amended requires an abnormality of mental functioning arising from a recognised medical condition, which substantially impaired the defendant's ability to understand the nature of his conduct, form a rational judgment, or exercise self-control, and which provides an explanation for the killing. A common error is to treat intoxication as a recognised medical condition. Alcohol dependency syndrome may qualify if it constitutes a recognised medical condition (R v Wood), but voluntary acute intoxication does not. Students often write that the defendant was drunk and therefore not fully responsible, which is legally insufficient. The defence must link the killing to the abnormality, not merely to disinhibition from drink.

7. Involuntary Manslaughter: Unlawful Act and Gross Negligence |

Involuntary manslaughter covers killings where the defendant lacks malice aforethought but still bears criminal responsibility. Unlawful act manslaughter (also called constructive manslaughter) requires an intentional (not merely negligent) unlawful act that is dangerous and causes death. The dangerousness test is objective: would a reasonable and sober person recognise the risk of some harm (R v Church)? Many students misdirect themselves by asking whether the defendant realised the act was dangerous, when the test is purely objective. Also, the unlawful act must be criminal in nature, not just a civil wrong. An act of trespass, for example, is insufficient unless there is an additional criminal element. Students sometimes cited tortious negligence as the unlawful act, which is a fundamental error.

Gross negligence manslaughter requires a duty of care, a breach of that duty creating an obvious and serious risk of death, and the breach must be so gross as to amount to a crime (R v Adomako). The danger here is failing to distinguish between civil negligence and gross negligence. Civil negligence involves a failure to meet the reasonable standard; gross negligence involves conduct so reprehensible that it deserves criminal sanction. Markers look for language such as 'the defendant's conduct showed such disregard for the life and safety of the victim that it can properly be condemned as criminal'. Students who simply state the doctor was negligent and the patient died, without explaining why the negligence was 'gross', will not achieve high marks. Reference to the jury's perspective as emphasised in R v Sellu and R v Bawa-Garba is beneficial.

8. Offer and Acceptance: The Basis of Contract |

In A2 contract law, offer and acceptance appear in both essay and problem questions. A high-frequency error is misclassifying an invitation to treat as an offer. Display of goods in a shop window (Fisher v Bell) or on shelves (Pharmaceutical Society of GB v Boots Cash Chemists) are invitations to treat. Advertisements are generally invitations to treat (Partridge v Crittenden), unless they amount to a unilateral offer, as in Carlill v Carbolic Smoke Ball Co. Students often label any advertisement offering a reward as a unilateral offer without checking whether the wording shows an intention to be bound. In the exam, if you state 'the advertisement is an offer', you must immediately justify with the three elements from Carlill: prescribed act, waiver of communication, and intention to be bound evidenced by the deposit of money.

橱窗陈列(Fisher v Bell)或货架展示(Pharmaceutical Society of GB v Boots Cash Chemists)均属要约邀请。

Acceptance must be communicated and must mirror the terms of the offer. A common mistake is treating silence as acceptance, which is generally ineffective (Felthouse v Bindley). The postal rule (Adams v Lindsell) is frequently misapplied to modern communications. The postal rule only applies where it is reasonable to accept by post and the letter is properly posted; it does not apply to instantaneous methods such as telephone, fax, or email (Entores Ltd v Miles Far East Corporation). Many students incorrectly state that an email acceptance is effective on sending, losing marks by conflating different modes. In problem questions, always first determine whether the acceptance method is instantaneous or non-instantaneous.

9. Consideration and Promissory Estoppel |

Consideration must be sufficient but need not be adequate. The rule that past consideration is not good consideration is examined frequently. However, an exception exists where the promisee performed the earlier act at the promisor's request and both parties understood that payment would be made (Lampleigh v Braithwait). Students sometimes answer that past consideration is always invalid, overlooking this established exception. Another pitfall concerns performance of an existing duty. Performance of a public duty imposed by law is not good consideration unless something extra is provided (Collins v Godefroy). Performance of a contractual duty owed to a third party can be good consideration (Scotson v Pegg), but students often incorrectly extend this to duties owed to the same promisor, where the rule in Stilk v Myrick applies unless it falls within the practical benefit exception (Williams v Roffey Bros).

Promissory estoppel can only be used as a shield, not a sword. This equitable doctrine prevents a promisor from going back on a promise where the promisee has relied on it to his detriment, but it does not create a new cause of action. A classic error is to use promissory estoppel to found a claim for damages when no contract exists. Additionally, many candidates forget that promissory estoppel is suspensory in effect unless the debt has been permanently extinguished or it would be inequitable to revive the original obligation. The judgment of Denning J in Central London Property Trust v High Trees House must be explained with precision. Avoid simply stating that 'estoppel stops the promisor from demanding the full amount'; clarify that it suspends the right during the period of reduced payment, and the original terms may revive on reasonable notice.

10. Negligence: Duty of Care, Breach, and Damage |

The three-stage test from Caparo Industries v Dickman (1990) is central: foreseeability of damage, proximity, and whether it is fair, just and reasonable to impose a duty. Students often jump to the Caparo test without acknowledging existing duty situations. Where a duty has already been established—such as driver to other road users (Nettleship v Weston) or doctor to patient (Bolam)—the court applies the established duty and only resorts to Caparo in novel situations. Failing to recognise an established duty and unnecessarily applying Caparo wastes time and may lead to an incorrect analysis.

Breach of duty involves the reasonable person test. For professionals, the standard is adjusted to that of the reasonable professional in that field (Bolam test, modified by Bolitho to require logical basis). A common mistake is to apply the Bolam test to ordinary defendants. If a learner driver causes an accident, he is judged by the standard of an ordinary competent driver, not a learner (Nettleship v Weston). Similarly, children are judged by the standard of a reasonable child of the same age (Mullin v Richards). In exams, many candidates use a generic 'reasonable person' for all defendants, failing to adjust for special standards. This loses crucial marks in problem questions where the defendant's characteristics matter.

11. Damages in Tort: Compensatory and Other Remedies |

Damages in negligence aim to restore the claimant to his pre-tort position. Special damages (quantifiable to the date of trial) and general damages (future losses, pain and suffering) must be distinguished. A common error is to treat loss of future earnings as special damages, when they are general damages. Students also forget to explain the multiplier and multiplicand method for calculating future loss, which can be required in A2 CCEA law essays. Mulitplier is the number of years the loss will continue, multiplicand is the annual loss. A brief mention of the Ogden Tables adds precision. Additionally, the duty to mitigate loss is often ignored; a claimant who refuses reasonable medical treatment may see his damages reduced. Omitting this principle undermines a complete answer.
