IGCSE CIE
1. Understanding the Question Types |
IGCSE Law papers contain two main types of essay questions: problem questions and thematic essays. Problem questions provide a short scenario and ask you to advise on the legal liability of the parties involved. Thematic essays, by contrast, invite you to explain a legal principle, discuss its development, or evaluate a specific area of law. Identifying the question type is the first step because it determines the structure you should use.
2. The General Essay Structure |
Every high-scoring legal essay follows a logical sequence: Introduction, Body, and Conclusion. In an introduction, you should identify the area of law, state the key issue, and outline the legal framework you will apply. The body paragraphs must each tackle one legal element, supported by authority. Finally, the conclusion should summarise your findings and state a clear outcome. This structure works for both problem questions and thematic essays, though the balance between explanation and application shifts accordingly.
3. Crafting an Effective Introduction |
Begin with a sentence that frames the legal context, e.g. 'This question concerns criminal liability for non-fatal offences against the person.' Next, define the relevant legal concept, such as murder or negligence, and name the key elements that must be proved. In a problem question, briefly connect the facts to those elements. Avoid lengthy background or repetition of the scenario wording. An ideal introduction takes no more than four to five lines and acts as a roadmap for the examiner.
4. Building Body Paragraphs: The PEEL Method | 构建主体段落:PEEL 方法
Use the PEEL technique: Point, Evidence, Explanation, Link. Each paragraph should start with a clear point that states the legal element you are discussing. Next, provide evidence in the form of a case name or statute section, together with its principle. Then explain how that principle applies to the facts of the scenario or the theme of the essay. Finally, link back to the overall question, showing why this point matters for the final outcome. This structure keeps your argument tight and prevents drifting off-topic.
5. Using Cases and Statutes Correctly |
A strong legal essay uses authority to back up every proposition. When a principle arises from case law, give the case name, e.g. Donoghue v Stevenson [1932], and state the 'ratio decidendi' – the legal rule for which the decision stands. For statutory provisions, cite the relevant section, such as 's. 18 of the Offences Against the Person Act 1861'. Never merely list case names; explain why they are relevant. The examiner wants to see that you understand the principle, not that you have memorised a catalogue of citations.
6. Writing a Strong Conclusion |
The conclusion should not introduce new material. Instead, it should briefly summarise how the legal elements have been satisfied or not satisfied on the facts, and state the likely outcome: 'It is therefore submitted that David is liable for murder because both the actus reus and mens rea are established.' In a thematic essay, the conclusion might reflect on the effectiveness or fairness of the law. A crisp, confident ending leaves a positive final impression.
7. Model Answer: Criminal Law (Murder) |
Scenario: James and Mark argue in a pub. James punches Mark, who falls, hits his head on the floor and dies. Discuss James' criminal liability for murder.
The actus reus of murder is the unlawful killing of a human being under the Queen's peace. Here, Mark's death was caused by James' punch, which set off a chain of events. Using the 'but for' test from R v White, but for James' punch, Mark would not have died. The actus reus is therefore satisfied.
For mens rea, the prosecution must prove an intention to kill or cause grievous bodily harm (GBH). Direct intent arises where death is the defendant's aim; oblique intent, per R v Woollin, applies where death or GBH was a virtual certainty and the defendant foresaw it. James threw a single punch in a pub argument. There is no evidence he wanted Mark to die. However, a punch can be seen as intending GBH if severe, but the facts suggest minor force. It is unlikely a court would find the necessary intention for murder; manslaughter may be more appropriate.
Conclusion: Although the actus reus of murder is clearly made out, establishing the mens rea is problematic. James is unlikely to be convicted of murder. He may instead be charged with involuntary manslaughter under an unlawful and dangerous act, following R v Church.
8. Model Answer: Tort Law (Negligence) |
Scenario: A supermarket fails to clean up a milk spillage. Patricia slips, falls and breaks her arm. She was texting on her phone and did not see the warning sign placed nearby. Advise Patricia on her negligence claim.
To succeed in negligence, a claimant must prove duty of care, breach, causation, and damage. The duty owed by an occupier to visitors is governed by the Occupiers' Liability Act 1957, but common law negligence applies similarly. The supermarket owed Patricia a duty of care as a customer: Donoghue v Stevenson established that a manufacturer (and by analogy, an occupier) owes a duty to those closely affected by their acts.
Breach occurs when the defendant falls below the standard of a reasonable person. The supermarket knew or should have known about the spillage and failed to clean it promptly. Leaving the floor wet for an extended period without adequate warning likely constitutes a breach. However, the warning sign was placed nearby. The issue is whether the sign was sufficient. A reasonable occupier would expect customers to be distracted and place cones beyond the spillage. The sign may not discharge the duty fully.
Causation applies the 'but for' test from Barnett v Chelsea and Kensington HMC. But for the spillage, Patricia would not have fallen. Factual causation is clear. However, the defendant may raise the defence of contributory negligence. Patricia was texting and failed to notice the sign, reducing her awareness. Under the Law Reform (Contributory Negligence) Act 1945, damages may be reduced if the claimant is partly to blame. A court is likely to find her 25-40% contributorily negligent.
Conclusion: Patricia has a valid negligence claim against the supermarket for breach of duty, but her damages will be significantly reduced due to her own failure to take reasonable care for her safety.
9. Time Management in the Exam |
IGCSE Law papers typically allow around 30 minutes per essay. Split this time into planning (5 min), writing (20 min), and checking (5 min). During planning, jot down the key legal elements, relevant cases, and a rough PEEL structure on scrap paper. Stick to your plan; do not rewrite the introduction. Leave yourself a few minutes at the end to correct obvious errors in case names or spelling and ensure each paragraph answers the question directly.
10. Common Mistakes to Avoid |
Starting without a plan leads to disorganised answers. Always spend the first five minutes structuring your essay.
Reciting case facts without stating the legal principle. The examiner needs the ratio, not the story of the snail in Donoghue.
Writing a conclusion that repeats the introduction. Instead, provide a concise outcome based on your analysis.
Ignoring the charge or claim asked in the question. If the question discusses a specific offence, do not drift into a general discussion of criminal law.
Running out of time on the first essay. Practise writing to a strict time limit at home.
