📚 IGCSE OCR Law: Key Rules & Principles Quick Reference | IGCSE OCR

This quick reference guide distils the essential rules, legal principles and landmark cases you need to master for the IGCSE OCR Law examination. Think of each point as a "formula" – a reliable framework you can apply to scenario questions. From the elements of a crime to the formation of a contract, these building blocks will help you structure your answers with precision.

1. Elements of Criminal Liability |

Actus Reus + Mens Rea + (No Defence) = Criminal Liability. Actus reus is the guilty act; it can be an act, an omission where a duty exists, or a state of affairs. Mens rea is the guilty mind, which for most crimes requires intention (direct or oblique) or recklessness (Cunningham). For strict liability offences, no mens rea is required for at least part of the actus reus.

Direct intent: defendant's aim or purpose (Mohan). Oblique intent: the result was a virtual certainty and the defendant appreciated that (Woollin). Recklessness: defendant foresaw a risk and went on to take it unreasonably (Cunningham). Transferred malice: intent to harm one person transfers to the actual victim (Latimer).

2. Homicide – Murder and Voluntary Manslaughter |

Murder: Unlawful killing of a reasonable creature in being under the Queen's/King's Peace with malice aforethought (intention to kill or cause grievous bodily harm). Voluntary Manslaughter arises when a defendant satisfies both actus reus and mens rea for murder but successfully pleads a partial defence: diminished responsibility, loss of control, or suicide pact.

Diminished responsibility (s.2 Homicide Act 1957 as amended): abnormality of mental functioning caused by a recognised medical condition, which substantially impaired the defendant's ability to understand the nature of their conduct, form a rational judgment, or exercise self-control. Loss of control (s.54-55 Coroners and Justice Act 2009): defendant's actions resulted from a loss of self-control triggered by a qualifying trigger (fear of serious violence or things said/done of an extremely grave character), and a person of the defendant's sex and age with a normal degree of tolerance would have reacted similarly.

3. Non-Fatal Offences Against the Person |

Key ladder of offences under the Offences Against the Person Act 1861 and common law: Assault (causing victim to apprehend immediate unlawful force, no need for physical contact) and Battery (application of unlawful force). Both are common law offences requiring intention or recklessness.

Assault occasioning actual bodily harm (s.47): assault or battery causing actual bodily harm – harm that is more than transient or trifling (Miller). Malicious wounding or inflicting grievous bodily harm (s.20): maliciously wounding or inflicting GBH; 'malice' here means intention or recklessness. Wounding or causing GBH with intent (s.18): requires specific intent to cause GBH or resist/prevent arrest. GBH means really serious harm (DPP v Smith).

4. Property Offences – Theft and Robbery |

Theft (s.1-6 Theft Act 1968): Dishonest appropriation of property belonging to another with the intention to permanently deprive. All five elements must be proved: appropriation (assuming the rights of the owner, Pitham & Hehl), property (including money, personal and real property, things in action, other intangible property), belonging to another, dishonesty (established by the Ghosh test now largely replaced by Ivey v Genting Casinos: was the conduct dishonest by the standards of ordinary decent people?), and intention to permanently deprive.

Robbery (s.8): Theft plus the use or threat of force immediately before or at the time of the theft, and the force must be used in order to steal. The elements of theft must be present; if any is missing, there is no robbery. The force or threat need not be against the victim of the theft (e.g. against a bystander).

5. Defences in Criminal Law |

Insanity (M'Naghten Rules): Defendant must prove on balance of probabilities that at the time of the act they were labouring under a defect of reason from a disease of the mind, so as not to know the nature and quality of the act, or if they did know, that they did not know it was wrong. Automatism: An act done by the muscles without any control of the mind (e.g. spasm) or an act done by a person who is not conscious of what they are doing – caused by an external factor. Intoxication: Voluntary intoxication is no defence to crimes of basic intent, but may be a defence to crimes of specific intent if it prevented the defendant from forming the required intent. Involuntary intoxication is a defence if the defendant lacked the mens rea.

Self-defence / defence of property: A person may use such force as is reasonable in the circumstances for self-defence or defence of another or property. Force must be necessary and proportionate to the threat as the defendant honestly believed it to be (even if mistaken, provided the mistake was not induced by voluntary intoxication). Duress: Defence to all crimes except murder and treason; the defendant was forced to commit a crime by threat of death or serious personal injury. Threat must be of such gravity that a person of reasonable firmness sharing the defendant's characteristics would have succumbed.

6. Formation of a Contract |

A legally binding contract requires offer + acceptance + consideration + intention to create legal relations + capacity. Offer: A definite promise to be bound on specific terms (Gibson v Manchester City Council – statement of intention not an offer). An invitation to treat is not an offer but an invitation to make an offer (goods on display, Fisher v Bell; advertisements, Partridge v Crittenden). Acceptance: Unconditional agreement to all terms of the offer. The postal rule: acceptance by post takes effect when the letter is posted, not when received (Adams v Lindsell). However, the postal rule will not apply if it was unreasonable to use the post or the offeror excluded it. Acceptance must be communicated; silence cannot constitute acceptance (Felthouse v Bindley).

7. Consideration and Intention |

Consideration: Something of value given by each party – "the price of the promise". Rules: consideration must be sufficient but need not be adequate (Chappell v Nestle – chocolate wrappers were good consideration); past consideration is not good consideration (Re McArdle); performance of an existing duty is generally not good consideration unless it goes beyond the duty or provides a practical benefit (Williams v Roffey Bros). Part payment of a debt is not good consideration for a promise to waive the balance (Pinnel's case), unless there is some extra element, or the doctrine of promissory estoppel applies.

Promissory estoppel: If a party makes a clear promise not to enforce their strict legal rights, and the other party relies on that promise and acts to their detriment, the promisor may be prevented from going back on the promise if it would be inequitable (Central London Property Trust v High Trees House). It operates as a shield, not a sword.

Intention to create legal relations: In social/domestic agreements, there is a presumption that there is no intention (Balfour v Balfour), rebuttable by clear evidence. In commercial agreements, the presumption is that there is intention, rebuttable by express wording (Rose & Frank v Crompton – "honour clause").

8. Terms and Breach of Contract |

Conditions: Major terms going to the root of the contract; breach entitles the innocent party to repudiate the contract and claim damages (Poussard v Spiers). Warranties: Minor terms; breach only entitles the innocent party to damages, not termination (Bettini v Gye). Innominate terms: The remedy depends on the seriousness of the breach – if it deprives the innocent party of substantially the whole benefit, treated as a condition; otherwise as a warranty (Hong Kong Fir Shipping v Kawasaki Kisen Kaisha).

Express terms are those stated by the parties. Implied terms can be implied by statute (e.g. Sale of Goods Act 1979 – satisfactory quality, fitness for purpose) or by the courts (business efficacy test, The Moorcock).

9. Negligence – Duty, Breach, Damage |

To establish negligence, the claimant must prove: duty of care, breach of that duty, and damage caused by the breach (causation and remoteness). Duty of care: Established by the Caparo three-part test – foreseeability of harm, proximity, and whether it is fair, just and reasonable to impose a duty (Caparo Industries v Dickman). In many established relationships, duty is automatically recognised (doctor-patient, driver-other road users).

Breach: The defendant's conduct fell below the standard of the reasonable man (Blyth v Birmingham Waterworks). Factors include: likelihood of harm, seriousness of harm, cost of taking precautions, and any social utility of the defendant's conduct. Professional standard: the test is the standard of the ordinary competent professional (Bolam test, modified by Bolitho to require a logical basis).

Damage – Causation: Factual causation – the "but for" test (Barnett v Chelsea & Kensington Hospital). Legal causation – the damage must not be too remote. The test for remoteness: was the kind of damage reasonably foreseeable (The Wagon Mound (No 1))? The thin skull rule: the defendant must take the victim as found and cannot escape liability because the victim had an unusual vulnerability.

10. Occupiers' Liability |

Occupiers' Liability Act 1957 covers lawful visitors. Occupier owes a common duty of care to see that the visitor is reasonably safe in using the premises for the purposes for which they are invited or permitted. The duty extends to risks of damage to property. Children must be expected to be less careful (Glasgow Corp v Taylor). An occupier may discharge the duty by giving warnings of the danger.

Occupiers' Liability Act 1984 covers trespassers (non-visitors). Occupier owes a duty if: (a) they are aware of the danger or have reasonable grounds to believe it exists; (b) they know or have reasonable grounds to believe that someone is in or may come into the vicinity of the danger; (c) the risk is one against which, in all the circumstances, they may reasonably be expected to offer some protection. Duty is to take such care as is reasonable in all the circumstances to see that the trespasser does not suffer injury. Warnings of danger may discharge the duty.

11. Law Making and the Hierarchy of Courts |

Parliamentary law-making ading, second reading, committee stage, report stage, third reading in each House) → Royal Assent. Judicial precedent: The doctrine of stare decisis. Ratio decidendi (binding reason for the decision) creates precedent; obiter dicta (remarks in passing) are persuasive. The hierarchy of courts determines which decisions are binding. The Supreme Court is the highest domestic court, binding all below. It is not strictly bound by its own decisions but will generally follow them (Practice Statement 1966). The Court of Appeal is bound by the Supreme Court and normally bound by its own previous decisions with limited exceptions (Young v Bristol Aeroplane).

Statutory interpretation: Rules of interpretation assist judges. Literal rule: words given their ordinary dictionary meaning. Golden rule: where literal rule leads to absurdity, the court may modify the meaning (R v Allen – 'marry' includes going through the ceremony). Mischief rule: judges look at the gap in the law that the statute was intended to cover and interpret accordingly (Smith v Hughes). Purposive approach: broader, considers the purpose of the Act, used especially with EU-derived legislation.

12. The Legal Profession and Funding |

Barristers and solicitors: Solicitors mainly provide legal advice, prepare cases, and may represent clients in lower courts. Barristers specialise in advocacy in higher courts and provide specialist advice. The "cab-rank rule" requires a barrister to accept any case in their area of practice. Judges are appointed from experienced barristers or solicitors. Legal funding: For criminal cases, suspects at police stations may receive free legal advice. In court, legal aid may be available subject to interests of justice and means testing. For civil cases, legal aid was drastically reduced by LASPO 2012; conditional fee agreements ("no win, no fee") are common. McKenzie friends can assist litigants in person but do not have rights of audience.
