1. Murder and Voluntary Manslaughter |

Murder is defined as the unlawful killing of a reasonable creature in being under the Queen's Peace with malice aforethought, express or implied. The crucial element of malice aforethought means an intention to kill or cause grievous bodily harm (GBH). A common mistake is to confuse intention with motive or premeditation. The key case R v Vickers confirmed that intention to cause GBH suffices for murder, even if the defendant did not foresee death. In problem questions, candidates often forget to state the legal definition fully before applying it to the facts. For partial defences to murder, voluntary manslaughter arises when the defendant successfully pleads diminished responsibility (s.2 Homicide Act 1957 as amended by s.52 Coroners and Justice Act 2009) or loss of control (s.54-55 Coroners and Justice Act 2009). A high-frequency error is mixing up the old law of provocation with the new loss of control test. For example, many students still refer to the requirement of a 'sudden and temporary loss of self-control' without recognising that the current law no longer requires the loss of control to be sudden, though it still must be qualifying. Also, the qualifying triggers must be carefully analysed: the fear of serious violence trigger and/or the things said or done trigger which constituted circumstances of an extremely grave character and caused the defendant to have a justifiable sense of being seriously wronged. Candidates frequently misapply the objective test for the normal person of the defendant's sex and age, with a normal degree of tolerance and self-restraint, forgetting that the circumstances (but not the defendant's general personality) are attributed to the normal person. For diminished responsibility, the abnormality of mental functioning must arise from a recognised medical condition and substantially impair the defendant's ability to understand the nature of conduct, form a rational judgment, or exercise self-control. The common mistake here is to omit the causal link between the abnormality and the killing; it is not enough to simply state the defendant was depressed. Examiner reports highlight that many students fail to explain how the condition substantially impaired the relevant ability.

2. Involuntary Manslaughter |

Involuntary manslaughter covers unlawful act manslaughter, gross negligence manslaughter, and reckless manslaughter (though in Edexcel, the focus is on the first two). Unlawful act manslaughter requires an intentional act (not omission) that is unlawful, dangerous, and causes death. The dangerousness test is objective: would a sober and reasonable person realise the act carried some risk of harm (not necessarily serious harm) (R v Church). A very common mistake is to analyse the act as 'unlawful' but then substitute the reasonable person with what the defendant actually foresaw. Students also tend to forget that the unlawful act must be a crime, not a civil wrong, and that the act must be the substantial cause of death. Furthermore, the chain of causation analysis must be done carefully: medical negligence is unlikely to break the chain unless it is so independent and potent as to render the original act insignificant (R v Cheshire). Another typical error occurs when combining the elements: the defendant has committed a battery, but the victim dies of a heart attack due to a pre-existing condition; students frequently misapply the thin skull rule and fail to explain that the act was still dangerous in the sense of risking some harm to a normal person, even if the actual harm was greater. Gross negligence manslaughter requires a duty of care, a breach of that duty in a way that was grossly negligent, and the breach caused death. The breach must be so egregious that it can be characterised as criminal (R v Adomako; R v Broughton). The common mistake here is inadequate explanation of why the negligence was 'gross'. Simply stating 'the doctor made a mistake' is insufficient; you must explain how the conduct fell far below the standard expected of a reasonable person in that position. Also, many candidates erroneously apply the civil duty of care principles from Caparo without recognising that criminal negligence duties can arise from a much broader range of circumstances, including assumptions of responsibility or creation of a dangerous situation.

3. Non-Fatal Offences Against the Person |

The hierarchy of non-fatal offences (assault, battery, assault occasioning actual bodily harm (ABH), malicious wounding or inflicting GBH, and wounding or causing GBH with intent) is a staple of Edexcel Paper 2. Assault requires causing the victim to apprehend immediate unlawful force; battery is the actual application of unlawful force. The common mistake in battery is forgetting that it can be committed by an indirect act, such as setting a trap, and that force can be minimal touching. For ABH under s.47 Offences Against the Person Act 1861, the assault or battery must occasion (cause) actual bodily harm, which includes psychiatric injury but not mere emotions (R v Chan-Fook). Students often lose marks by not defining 'actual bodily harm' and by conflating ABH with GBH – ABH is harm that is more than transient or trifling, whereas GBH is really serious harm (DPP v Smith). For s.20 malicious wounding or inflicting GBH, the mens rea is 'maliciously', meaning intention or subjective recklessness as to some harm (not necessarily serious harm) (R v Mowatt). A critical exam error is stating that the defendant must intend or be reckless as to GBH for s.20 – this is wrong; recklessness as to any physical harm suffices. For s.18, the intention must be to cause GBH or to resist/prevent lawful apprehension, and this specific intent must be proved. Students frequently confuse the actus reus of s.20 ('inflict' GBH) with s.18 ('cause' GBH) and fail to note that 'inflict' has been interpreted broadly to be synonymous with 'cause' (R v Burstow). Another high-frequency pitfall is the transmission of disease cases – battery can be committed where the victim does not consent to the risk of disease, and recklessness in this context requires the defendant to be aware of the risk (R v Dica). In exam scenarios, students often misidentify the offence by jumping to the most serious without first establishing the building blocks of the lower offences.

4. Property Offences: Theft, Robbery, and Burglary |

Theft, defined under s.1 Theft Act 1968, requires the dishonest appropriation of property belonging to another with the intention to permanently deprive. Many candidates lose focus on the actus reus elements, particularly 'appropriation'. Any assumption of the rights of an owner can amount to appropriation, even if done with consent (R v Gomez; R v Hinks). The current test for dishonesty is the Ivey v Genting Casinos test: first, ascertain the defendant's actual state of knowledge or belief as to the facts; second, determine whether the conduct was dishonest by the standards of ordinary decent people. A high-frequency mistake is to still apply the old Ghosh test with its subjective second limb, or to forget that the Ivey test is now the law. Additionally, students often fail to consider whether the property belonged to another at the time of appropriation – for instance, in cases of abandoned property or where the defendant had a legal obligation to return property, the 'belonging to another' interpretation can be problematic. For robbery (s.8), the defendant must steal and, immediately before or at the time of doing so, use force on any person or put or seek to put any person in fear of being then and there subjected to force. The force must be used in order to steal, not as an afterthought. Mistake often appears in sequencing: the force or threat must be applied before or at the time of the theft, not after the appropriation is complete (R v Hale). Burglary under s.9 requires entering a building or part of a building as a trespasser with intent to commit one of the ulterior offences (s.9(1)(a)) or having entered as a trespasser, committing or attempting to commit theft or GBH (s.9(1)(b)). The highest error rate is on the 'entry' requirement – entry must be effective, but even partial entry can suffice, and on the notion of a 'building', which includes inhabited vehicles or vessels. Make sure you explain the distinction between the two types of burglary and specify which one is being charged in a scenario.

5. Defences in Criminal Law |

Defences such as self-defence, intoxication, and consent are perennially tested. Self-defence under s.3 Criminal Law Act 1967 and common law allows reasonable force in the prevention of crime or in defence of self or another. The question of whether the force was reasonable is judged according to the circumstances as the defendant honestly believed them to be, even if the belief was mistaken (R v Williams (Gladstone)). However, evidence of intoxication cannot be used to support a mistaken belief if the intoxication was voluntary (R v O'Grady). A common mistake is to fail to separate the two-limb test: was the use of force necessary? and was the degree of force proportionate? Students often blend these into one question. Another error is applying an objective reasonableness test to the belief, ignoring the subjective element. Intoxication is a tricky defence because it is only available to negate specific intent offences if the intoxication was involuntary or if voluntary intoxication prevented the defendant from forming the specific intent (DPP v Majewski). For basic intent offences, voluntary intoxication cannot be used as a defence, even if it led to a mistake. The mistake here is to claim intoxication as a full defence for any crime, rather than understanding the specific/basic intent distinction. Consent is primarily a defence to battery and sometimes ABH, but cannot generally be given for GBH or death unless within recognised 'good reason' categories such as medical treatment, sports, or horseplay (R v Brown; R v Wilson). The frequent misstep is applying a blanket rule that consent can never be a defence to any harm above battery, missing the public interest exceptions. Ensure you explain the boundaries of consent with reference to the nature and degree of harm and the social utility of the activity.

6. Tort Law: Negligence – Duty, Breach, and Damage |

Negligence is the dominant topic in Edexcel Tort. The three-part test from Caparo Industries plc v Dickman for establishing a duty of care (foreseeability of damage, proximity, and whether it is fair, just and reasonable to impose a duty) is quoted frequently but applied superficially. High-frequency errors include treating Caparo as a checklist rather than integrating its principles into novel scenarios. For established duty situations (e.g., road user to road user, doctor to patient), do not waste time on Caparo; simply state the duty exists. Breach of duty is decided by the objective standard of the reasonable man. Special standards apply for professionals (the Bolam test: a professional is not negligent if they acted in accordance with a practice accepted as proper by a responsible body of professional opinion, Bolam v Friern Hospital Management Committee, subject to the Bolitho gloss that the practice must withstand logical analysis) and for learners (same standard as a competent, experienced person, Nettleship v Weston). The chief mistake is to apply the Bolam test to non-professional defendants or to overlook the factors that adjust the standard of care: the probability of injury, the seriousness of the injury, the cost and practicality of precautions, and the social value of the defendant's activity. In causation, factual causation uses the 'but for' test, and legal causation requires the damage to be a reasonably foreseeable consequence, with no effective intervening new act (novus actus interveniens). Many candidates combine factual and legal causation into one vague analysis. Instead, you must clearly separate them and discuss intervening acts such as third-party intervention, unforeseeable natural events, or the claimant's own unreasonable conduct. Damage must not be too remote – the type of damage must be foreseeable, even if the extent was not (Wagon Mound No.1). The thin skull rule applies to extent but not to unforeseeable type of damage.

7. Occupiers' Liability |

Occupiers' liability covers the Occupiers' Liability Act 1957 (lawful visitors) and the Occupiers' Liability Act 1984 (trespassers). For the 1957 Act, the common duty of care is to take such care as in all the circumstances is reasonable to see that the visitor will be reasonably safe in using the premises for the purposes for which they are invited or permitted. The occupier must be prepared for children to be less careful, and persons exercising a calling are expected to appreciate and guard against special risks ordinarily incidental to their calling. A typical mistake is to treat warning signs as automatically discharging the duty; the warning must be sufficient to enable the visitor to be reasonably safe, not just inform them of the presence of danger (Roles v Nathan). Also, discharging the duty to an independent contractor is possible if it was reasonable to entrust the work, the contractor was competent, and the occupier inspected the work if appropriate. The 1984 Act imposes a duty on occupiers to persons other than visitors if three conditions are met: the occupier is aware of the danger or has reasonable grounds to believe it exists; the occupier knows or has reasonable grounds to believe the other person is in the vicinity of the danger or may come into the vicinity; and the risk is one against which, in all the circumstances, the occupier may reasonably be expected to offer some protection. The duty is to take such care as is reasonable in all the circumstances to see that the person does not suffer injury on the premises by reason of the danger. High-frequency errors include confusing the tests under the 1957 and 1984 Acts, applying the 1957 Act's 'reasonable safety' wording to a trespasser scenario, or failing to explain that the 1984 Act excludes liability for property damage and requires personal injury. Moreover, the concept of an 'occupier' is broadly defined as someone who exercises a sufficient degree of control over the premises, not necessarily the owner. Students often incorrectly identify the occupier based on legal title alone.

8. Private Nuisance and the Rule in Rylands v Fletcher | 私人妨害与 Rylands v Fletcher 规则

Private nuisance protects a person's right to use and enjoy their land. The key factors for determining whether an interference is unreasonable include the duration, intensity, character of the neighbourhood, sensitivity of the claimant, and malice. A recurrent error is to treat private nuisance as a personal injury tort; it is a tort against land, and only those with a proprietary interest in the land can sue (Hunter v Canary Wharf). The concept of 'abnormal sensitivity' often causes confusion: if the interference would not bother a normal person, there is no nuisance unless the defendant acted maliciously. Public nuisance is sometimes tested alongside private nuisance, so be clear that public nuisance is a crime and a tort, and a claimant in tort must show special damage over and above that suffered by the public at large. The rule in Rylands v Fletcher imposes strict liability for damage caused by the escape of a thing likely to do mischief if it escapes, brought onto the defendant's land, provided the use of the land was a non-natural use. The classic pitfalls are misunderstanding 'non-natural use' – it must be some special use bringing with it increased danger to others and not an ordinary use of land (Transco plc v Stockport MBC); mistaking it for a nuisance claim; and forgetting the need for an escape from the defendant's land to the claimant's land. Many exam answers also fail to discuss the defences to Rylands v Fletcher, such as act of a stranger, act of God, consent, and statutory authority, which can be crucial to liability.

9. Vicarious Liability |

Vicarious liability is a method of imposing liability on an employer for torts committed by an employee in the course of employment. The modern two-stage test requires: (1) was the tort committed by an employee or someone in a relationship akin to employment? and (2) was the tort committed in the course of employment, meaning it was so closely connected with the employment that it would be fair and just to hold the employer liable (Various Claimants v Catholic Child Welfare Society; Cox v Ministry of Justice)? The old 'Salmond test' for authorised acts or unauthorised modes of authorised acts is still relevant but often needs to be integrated with the close connection test. Common mistakes include restricting the analysis to classic employment relationships and ignoring that independent contractors are generally outside vicarious liability, except in certain non-delegable duty cases. Another error is failing to distinguish between an employee acting on a frolic of his own and acting in the course of employment; the close connection test can capture intentional wrongful acts, including assault, if there is a sufficient link between the authorised task and the wrongful conduct (Lister v Hesley Hall). Students often lose marks by summarising the facts of Lister without applying the close connection principle to the given scenario. Additionally, candidates should address that vicarious liability is a secondary liability and that the primary liable tortfeasor (employee) must have committed a tort before any liability can be shifted.
