1. Judicial Precedent (Stare Decisis) |
The doctrine of precedent requires courts to follow previous decisions where the material facts and legal issues are similar, ensuring consistency and fairness. A binding precedent is created when the ratio decidendi – the legal reason for the decision – comes from a higher court in the same hierarchy.
Key Latin maxim: Stare decisis et non quieta movere – to stand by decisions and not disturb settled points.
Ratio decidendi → binding | Ratio decidendi → 约束力
Obiter dicta → persuasive only | Obiter dicta →
The Supreme Court (formerly the House of Lords) is generally bound by its own previous decisions, but may depart "when it appears right to do so" under the Practice Statement 1966. The Court of Appeal is bound by its own decisions, subject to the three exceptions in Young v Bristol Aeroplane Co Ltd (1944): conflicting decisions, decisions made per incuriam, and decisions that are effectively overruled by the Supreme Court.
- Original precedent: A point of law is decided for the first time (e.g., Donoghue v Stevenson on the neighbour principle).
- Distinguishing: Judges avoid an otherwise binding precedent by finding the material facts significantly different.
2. Statutory Interpretation Rules |
When the meaning of a statute is unclear, judges apply interpretation rules to ascertain Parliament's intention. The three main traditional rules are the literal rule, the golden rule, and the mischief rule. Modern courts also use the purposive approach, which looks at the broader purpose of the legislation.
| Literal rule (字面规则):Words given ordinary dictionary meaning even if result is absurd – Whitely v Chappell (1868); Fisher v Bell (1961). |
| Golden rule (黄金规则):Narrow approach: choose between possible meanings to avoid absurdity – R v Allen (1872). Wide approach: modify words to avoid a repugnant result – Re Sigsworth (1935). |
| Mischief rule (弊端规则):Examine the common law before the Act, identify the problem the Act was designed to remedy – Heydon’s Case (1584); Smith v Hughes (1960). |
| Purposive approach (目的解释):Focus on the legislative purpose, often using Hansard under Pepper v Hart (1993) – Jones v Tower Boot Co (1997). |
Internal (intrinsic) aids: the statute itself – long title, preamble, interpretation sections. External (extrinsic) aids: dictionaries, previous Acts, Law Commission reports, Hansard.
3. Hierarchy of Courts & Appeals |
The English court system is structured in a clear hierarchy, crucial for understanding which decisions bind which courts. Criminal courts and civil courts form two main streams, both feeding into the Supreme Court.
Supreme Court (formerly HoL) ↑ |
Court of Appeal (Criminal Division / Civil Division) ↑ |
High Court (QBD, Chancery, Family) ↑ |
Crown Court / County Court ↑ |
Magistrates’ Court / First-tier Tribunals |
In criminal cases, appeals from the Magistrates’ Court go to the Crown Court (full rehearing) or by way of case stated to the Queen’s Bench Division on a point of law. From the Crown Court, appeal lies to the Court of Appeal Criminal Division, and finally to the Supreme Court on a point of law of general public importance.
4. Criminal Liability: Actus Reus & Mens Rea |
Every criminal offence requires an actus reus (guilty act) and mens rea (guilty mind) unless the offence is one of strict liability. Both must coincide in time for liability to arise.
Actus reus components: conduct (an act or, exceptionally, an omission where a duty exists – R v Pittwood), circumstances (e.g., absence of consent in theft), and result (causation). Factual causation uses the "but for" test (R v White). Legal causation requires the defendant’s act to be a substantial and operating cause (R v Smith; R v Cheshire). The chain of causation may be broken by an intervening act of a third party or an unforeseeable natural event.
Mens rea types: intention (direct: aim/purpose; oblique: consequence virtually certain and defendant foresaw it – R v Woollin), recklessness (foresight of an unjustifiable risk – subjective Cunningham test), negligence (falling below the standard of the reasonable person, used mainly in tort, but gross negligence manslaughter is an exception), and transferred malice (R v Latimer; R v Pembliton).
Strict liability offences require no proof of mens rea for at least one element (e.g., driving whilst disqualified – R v Williams, food safety offences – Callow v Tillstone).
5. Non-Fatal Offences Against the Person |
The principal non-fatal offences under the Offences Against the Person Act 1861 and common law are assault, battery, assault occasioning actual bodily harm (ABH – s.47), malicious wounding or inflicting grievous bodily harm (GBH – s.20), and wounding or causing GBH with intent (s.18).
| Offence | Actus reus | Mens rea | Key case |
| Assault | 威胁 | Causing V to apprehend immediate unlawful force | Intention or recklessness | Logdon v DPP (1976) |
| Battery | 殴打 | Application of unlawful force, even slight touching | Intention or recklessness | Collins v Wilcock (1984) |
| ABH s.47 | Assault or battery resulting in actual bodily harm (more than transient or trifling – R v Chan-Fook) | Intention or recklessness as to the assault/battery (no need to foresee ABH – R v Savage) | R v Miller (1954) |
| GBH s.20 | Wounding (break both layers of skin) or inflicting GBH (really serious harm – DPP v Smith) | Intention or recklessness as to some harm (R v Mowatt) | R v Cunningham (1957) |
| GBH s.18 | Wounding or causing GBH | Intention to cause GBH or resist/prevent arrest (R v Belfon) | R v Morrison (1998) |
6. Defences in Criminal Law |
A defence either negates an element of the offence or provides a justification/excuse. Key general defences for AS Level include consent, self-defence, duress, and intoxication (voluntary and involuntary).
Consent: Valid consent may negate the actus reus of assault/battery. Consent must be genuine, informed, and the person must have capacity. Consent cannot be a defence to actual bodily harm or more serious injury unless the activity falls within a recognized public interest exception (e.g., sports, surgery, rough horseplay – R v Aitken; R v Brown).
Self-defence: A person may use reasonable force to protect themselves, another person, or property. The force must be necessary (subjective question) and proportionate (objectively reasonable in the circumstances as the defendant honestly believed them to be – R v Owino; s.76 Criminal Justice and Immigration Act 2008). Pre-emptive strikes are allowed (Beckford v R).
Duress: The defendant was forced to commit a crime due to a threat of death or serious injury. Duress is unavailable for murder (R v Howe), attempted murder, and where the defendant voluntarily joined a criminal gang that might put them under compulsion (R v Hasan).
Intoxication: Voluntary intoxication (by alcohol or dangerous drugs) is a defence only to crimes of specific intent (e.g., s.18 GBH, murder) if it prevented the defendant from forming the required intent (DPP v Majewski). It is not a defence to basic intent crimes (e.g., s.20, s.47, battery), where getting drunk is deemed reckless. Involuntary intoxication (slipped a drug) may be a defence to any crime if it negates mens rea (R v Kingston).
7. Tort Law: Negligence – Duty, Breach, Damage |
A successful negligence claim requires the claimant to prove three elements on the balance of probabilities: a duty of care, breach of that duty, and damage caused by the breach (causation and remoteness).
Duty of care: Neighbour principle → Caparo three-stage test
The Caparo test asks: (1) Was the harm reasonably foreseeable? (2) Was there proximity between the parties? (3) Is it fair, just and reasonable to impose a duty? (Caparo Industries plc v Dickman [1990]).
Breach of duty: The defendant must meet the standard of the reasonable person in their position (Blyth v Birmingham Waterworks). Factors include: likelihood of harm (Bolton v Stone), seriousness of harm (Paris v Stepney BC), cost of precautions (Latimer v AEC), and social utility (Watt v Hertfordshire CC). Special standards apply to professionals (Bolam test, modified by Bolitho) and learners (Nettleship v Weston).
Damage (causation): Factual causation uses the "but for" test (Barnett v Chelsea & Kensington Hospital). Legal causation requires the damage to be a reasonably foreseeable consequence (Wagon Mound No 1). The chain of causation can be broken by a novus actus interveniens. The thin skull rule (eggshell skull rule) ensures the defendant takes their victim as they find them (Smith v Leech Brain & Co).
8. Occupiers’ Liability |
Occupiers' liability deals with the duty owed by the occupier of premises to persons who enter those premises. Two statutes apply: the Occupiers' Liability Act 1957 covers lawful visitors; the 1984 Act covers trespassers.
1957 Act (visitors): The occupier owes a common duty of care to see that the visitor is reasonably safe in using the premises for the purposes for which they are invited (s.2(2)). An occupier is a person with sufficient control over the premises (Wheat v E Lacon & Co). Visitors lose their status if they exceed their permission. Special provisions apply to children (Glasgow Corp v Taylor), and to persons exercising a calling (Roles v Nathan). Warnings and independent contractors are relevant to discharging the duty (s.2(4); Haseldine v Daw).
1984 Act (trespassers): An occupier owes a limited duty to persons other than visitors if they are aware of the danger, know a trespasser may come into the vicinity, and the risk is one against which it is reasonable to offer some protection (s.1(3)). The duty is to take such care as is reasonable to see that the trespasser does not suffer injury on the premises (s.1(4)). Warnings may suffice to discharge the duty (s.1(5)). Key case: Ratcliff v McConnell (diving into shallow pool at night – no duty).
9. Contract Law: Offer & Acceptance |
A binding contract is formed when there is an offer, acceptance, consideration, intention to create legal relations, and sufficient certainty. Offer and acceptance determine the existence and terms of an agreement.
Offer: expression of willingness to contract on specified terms, made with the intention that it is to become binding as soon as it is accepted (Storer v Manchester City Council).
An invitation to treat is an invitation to negotiate, not an offer (Fisher v Bell; Pharmaceutical Society v Boots; Partridge v Crittenden). Advertisements are generally invitations to treat, unless they amount to a unilateral offer (Carlill v Carbolic Smoke Ball Co).
Acceptance: A final and unqualified expression of assent to the terms of the offer. The general rule is that acceptance must be communicated to the offeror (Entores v Miles Far East Corp). Silence cannot constitute acceptance (Felthouse v Bindley). The postal rule: where acceptance by post is reasonable, acceptance is effective at the moment the letter is posted (Adams v Lindsell), but this rule can be ousted by the offeror.
An offer may be terminated by revocation (must be communicated – Byrne v Van Tienhoven), rejection/counter-offer (Hyde v Wrench), lapse of time, death, or failure of a condition precedent.
10. Contract Law: Consideration |
Consideration is the price for which the promise of the other is bought. It must be sufficient but need not be adequate. Rules of consideration are essential to determine enforceability of agreements.
- Past consideration is not good consideration (Re McArdle); exception: prior request and implied understanding of payment (Lampleigh v Braithwait).
- Performance of an existing duty owed to a third party can be good consideration (Scotson v Pegg).
- Part payment of a debt: the rule in Pinnel’s Case – payment of a smaller sum on the due date is not satisfaction of a larger debt, unless there is some fresh element (e.g., early payment, different place, or addition of a chattel). The equitable doctrine of promissory estoppel can prevent a creditor going back on their promise to accept less where it would be inequitable (High Trees Case; but a "shield, not a sword").
Consideration must move from the promisee, but need not move to the promisor (Tweddle v Atkinson).
11. Legal Personnel: Judges, Barristers, Solicitors |
England and Wales has a divided legal profession. Barristers have rights of audience in all courts and tend to specialise in advocacy and specialist legal advice. Solicitors provide direct client services, often as the first point of contact, and can appear in lower courts; some now qualify as solicitor advocates with extended rights of audience.
Judges: Appointment to judicial office is governed by the Judicial Appointments Commission, based on merit and good character. The hierarchy includes Justices of the Supreme Court, Lord Justices of Appeal, High Court Judges, Circuit Judges, District Judges, and Magistrates (lay justices). Under the Constitutional Reform Act 2005, the Lord Chancellor’s role was reformed, separating the judiciary from the legislature. Superior judges have security of tenure and immunity from suit for their judicial functions.
Legal education: Typically, a qualifying law degree (or conversion course) followed by the Bar Training Course (for barristers) and pupillage, or the Solicitors Qualifying Examination (SQE) route and qualifying work experience. The Legal Services Act 2007 liberalised the market, allowing alternative business structures.
12. Civil Case Tracks & ADR |
The Civil Procedure Rules (CPR) introduced a case management system with three tracks, allocating cases based on value and complexity. This ensures proportionate allocation of court resources.
| Track (途径) | Typical value (典型标的额) | Features (特征) |
| Small claims (小额索赔) | Up to £10,000 (personal injury & housing disrepair: £1,000) | Informal, district judges, limited costs recovery, encourages self-representation. |
| Fast track (快速途径) | £10,000 – £25,000 | Trial within 30 weeks, standard directions, fixed costs, emphasis on streamlined procedure. |
| Multi-track (多轨途径) | Over £25,000 or complex | Flexible case management, tailored directions, possible High Court, broader disclosure. |
Alternative Dispute Resolution (ADR): Methods include negotiation, mediation (neutral third party facilitates agreement – not binding), conciliation (mediator suggests terms), arbitration (binding decision by an arbitrator under the Arbitration Act 1996), and early neutral evaluation. Courts actively encourage ADR through pre-action protocols and costs sanctions for unreasonable refusal to engage in ADR (Halsey v Milton Keynes General NHS Trust). ADR can be cheaper, quicker, and more private, but is not suitable if an injunction or precedent is required.
