1. Criminal Liability Formula |
The fundamental equation of crime:
Guilt = Actus Reus (AR) + Mens Rea (MR) - Defence
Actus reus is the guilty act — the physical element, which can be an act, omission (where a duty exists), or a state of affairs. Mens rea is the guilty mind — the mental element, such as intention, recklessness, or negligence. For a conviction, the prosecution must prove both AR and MR beyond reasonable doubt, and the defendant must have no valid defence (e.g., self‑defence, insanity). If any element is missing, the equation fails and liability is not established. This foundational formula underpins all criminal offences, from murder to theft.
The formula also explains strict liability offences, where MR is not required for at least one element of the AR. Here the equation simplifies to AR + no defence, shifting focus onto the act alone. Key case: Sweet v Parsley (1970) — presumption of MR unless statute clearly excludes it.
2. Murder |
= Unlawful Killing of a Human Being + Malice Aforethought (Intention to Kill or Cause GBH)
Murder is a common law offence. The actus reus requires the unlawful killing of a reasonable person in being under the Queen's (now King's) peace. The mens rea is malice aforethought, which means an intention to kill or to cause grievous bodily harm (GBH). This is a specific intent offence: recklessness is not enough. The defendant must have a direct or oblique intention — where death or GBH was a virtual certainty and the defendant appreciated that fact (R v Woollin 1999). Life imprisonment is the mandatory sentence upon conviction.
3. Voluntary Manslaughter: Loss of Control & Diminished Responsibility |
Voluntary Manslaughter = Murder – Partial Defence (Loss of Control or Diminished Responsibility)
Voluntary manslaughter arises when a defendant would be liable for murder but successfully raises a partial defence, reducing the conviction from murder to manslaughter. The two key partial defences under the Coroners and Justice Act 2009 are loss of control and diminished responsibility.
Loss of Control Formula: (1) D lost self‑control due to a qualifying trigger (fear of serious violence; things said/done of extremely grave character giving justifiable sense of being seriously wronged; or combination). (2) A person of D’s sex and age, with normal tolerance and in the same circumstances, might have reacted similarly (R v Clinton 2012). Sexual infidelity alone is excluded as a trigger, but can be considered alongside other factors.
Diminished Responsibility Formula: (1) Abnormality of mental functioning arising from a recognised medical condition. (2) Which substantially impaired D’s ability to understand the nature of their conduct, form a rational judgment, or exercise self‑control. (3) And provides an explanation for the killing. The burden of proof lies on D on the balance of probabilities (R v Byrne 1960, R v Golds 2016).
4. Involuntary Manslaughter: Unlawful Act & Gross Negligence |
Unlawful Act Manslaughter = Unlawful Act + Dangerous (Risk of Some Harm) + Causes Death
Also known as constructive manslaughter, this formula requires a base criminal offence (not negligence or omission). The act must be objectively dangerous — a sober and reasonable person would recognise the risk of some physical harm (R v Church 1966). The act must cause death; the defendant need not foresee death or serious harm. No additional mens rea for the death is required, as MR for the base offence suffices. Example: a punch causing victim to fall and fatally hit head qualifies if the punch was unlawful and dangerous.
ence Manslaughter = Duty of Care + Breach Causing Risk of Death + Gross Negligence + Death
The defendant must owe a duty of care (ordinary tort negligence principles, R v Adomako 1994). The breach must create a risk of death — not merely of harm. The negligence must be 'gross', meaning so severe as to be criminal, going beyond mere civil carelessness and showing disregard for life and safety (R v Bateman 1925). The breach must cause death. Medical professionals, employers, and even family members may be liable under this formula.
5. Non‑Fatal Offences: Assault, Battery, ABH, GBH |
ult = Intentional/Reckless Act Causing V to Apprehend Immediate Unlawful Personal Violence
Assault is a summary offence. No physical contact is needed; words can suffice (R v Ireland 1997 — silent phone calls). The victim must apprehend immediate force, though ‘immediacy’ is interpreted broadly. Mens rea is intention or subjective recklessness. Fear is not required — just the expectation of force.
Battery = Intentionally/Recklessly Applying Unlawful Force to V
Battery involves the slightest touching without consent, even via an object. Force must be direct or indirect (e.g., setting a trap). It can be reckless. Everyday jostling not included (implied consent). Cole v Turner (1704) — the least touching in anger is battery.
Assault Occasioning ABH = Assault or Battery + Actual Bodily Harm
Section 47 Offences Against the Person Act 1861. ABH means harm that is more than transient or trifling, including psychiatric injury (R v Miller 1954). Causation required. MR is the same as for the underlying assault or battery — no need to intend or foresee ABH.
/Inflicting GBH (s.20) = Unlawful Wounding or GBH + Intention/Recklessness as to Some Harm
GBH means 'really serious harm' (DPP v Smith 1961). Wounding requires a break in the continuity of the whole skin. MR is intention or recklessness as to some harm, not necessarily serious. Section 20 carries up to 5 years imprisonment.
g/Causing GBH with Intent (s.18) = s.20 AR + Specific Intent to Cause GBH or Resist Arrest
The most serious non‑fatal offence. AR same as s.20 — wounding or GBH. MR is specific intention to cause GBH, or intent to resist/prevent lawful arrest AND causing GBH recklessly. Maximum life imprisonment.
6. Property Offences: Theft, Robbery, Burglary |
onest Appropriation of Property Belonging to Another with Intention to Permanently Deprive
Theft Act 1968, s.1–6. All five elements must be proven. Appropriation includes assuming any rights of the owner, even with consent if later found dishonest (R v Gomez 1993). Property includes money, things in action, intangible property. Belonging to another is widely construed. Dishonesty is judged by the Ivey v Genting (2017) test: (1) What was D’s actual knowledge or belief as to the facts? (2) Was D’s conduct dishonest by the standards of ordinary decent people? No need for D to realise the dishonesty. Intent to permanently deprive includes treating the thing as one’s own regardless of owner’s rights.
Robbery = Theft + Force or Threat of Force Immediately Before or at the Time of Stealing
Theft Act 1968, s.8. If no theft is completed, no robbery — thus all theft elements are required. The force or threat must be used in order to steal. Force on anyone, not just the property holder. Timing is crucial: force must be immediately before or at the time of stealing.
Burglary = Entry into a Building/Trespass + with Intent/Mens Rea Specified in s.9
Burglary under s.9 has two variants. s.9(1)(a): Entry as trespasser with intent to commit theft, GBH, or criminal damage. s.9(1)(b): Entry as trespasser and then actually commits (or attempts) theft or GBH. Entry must be effective and substantial (R v Brown 1985), though any body part suffices. Building includes inhabited vehicles or vessels, and even large containers. Must know or be reckless as to trespass.
7. Negligence: The Tort Formula |
Negligence = Duty of Care + Breach of Duty + Causation (Factual & Legal) + Damage
Established in Donoghue v Stevenson (1932), the modern duty of care uses the Caparo v Dickman (1990) three‑part test: (1) Reasonable foreseeability of harm to this claimant; (2) Proximity of relationship (including physical, circumstantial, or causal proximity); (3) Fair, just and reasonable to impose a duty. Once duty exists, breach is assessed by the objective standard of the reasonable person (Blyth v Birmingham Waterworks 1856), adjusted for special characteristics (e.g., children, professionals). Professionals are judged by the standard of their profession (Bolam v Friern HMC 1957), modified by Bolitho. Factual causation asks 'but for' the breach, would the damage have occurred? (Barnett v Chelsea Hospital). Legal causation considers whether the damage is too remote — the type of damage must be reasonably foreseeable (The Wagon Mound (No 1)). Any intervening act may break the chain. Damage must be a recognised loss (personal injury, property damage, psychiatric harm under certain conditions).
8. Occupiers’ Liability |
ity Act 1957 (Visitors) = Occupier + Visitor + Common Duty of Care + Breach Causing Damage
An occupier is someone who has sufficient control over premises (Wheat v Lacon 1966). Visitors are those with express or implied permission, including invitees and licensees. The common duty is to 'take such care as in all the circumstances is reasonable to see that the visitor will be reasonably safe in using the premises for the purpose for which he is invited' (s.2(2)). Special regard for children who may be less careful, and for tradesmen exercising their calling. Warnings can discharge the duty if adequate. Independent contractors: occupier must ensure reasonable care in their work, unless it is technical and reasonable to entrust to a specialist. Defences include volenti and contributory negligence.
respasser + Aware of Danger + Risk of Injury on Premises + Failure to Take Reasonable Care
A duty is owed only if the occupier is aware of the danger (or has reasonable grounds to believe it exists); knows or has reasonable grounds to believe a trespasser might come into the vicinity; and the risk is one against which, in all the circumstances, the occupier may reasonably be expected to offer some protection. The duty is to take such care as is reasonable to see that the trespasser does not suffer injury on the premises by reason of the danger concerned. Warnings may suffice. No liability for property damage towards trespassers. This is a lesser duty than that owed to visitors.
9. Private Nuisance |
Private Nuisance = Unreasonable Interference with C's Use or Enjoyment of Land + Resulting Damage
Private nuisance protects an occupier’s interest in the beneficial use of land. The interference must be unreasonable, judged by factors including: duration, frequency, locality, sensitivity of claimant, malice of defendant, and public benefit (Sturges v Bridgman 1879, Christie v Davey 1893). Physical damage to property is easier to establish than personal discomfort. The claimant must have a proprietary interest in the land (Malone v Laskey 1907). Defences include prescription (20 years continuous lawful activity), and statutory authority. Coming to the nuisance is no defence.
10. The Rule of Law & Judicial Review Formula |
f Law ≈ No Arbitrary Power + Legal Certainty + Equality Before the Law + Access to Justice
Dicey’s core principles (modified today) underpin the UK constitution: no one can be punished except for a breach of law; everyone is subject to the ordinary law administered by ordinary courts; and constitutional rights derive from judicial decisions. While modern critiques highlight Parliamentary sovereignty tensions, the formula remains a benchmark for justice. Judicial review ensures public bodies act lawfully, rationally, fairly, and compatibly with human rights.
11. Statutory Interpretation Formula |
Construction = Word Meaning + Context + Purpose + Presumptions + External Aids
Judges deploy rules and aids. Literal rule gives words their plain, ordinary meaning (Fisher v Bell 1961). Golden rule allows departure from literal meaning to avoid absurdity (R v Allen 1872, Re Sigsworth 1935). Mischief rule examines the defect the statute was intended to remedy (Heydon’s Case 1584). Purposive approach looks at the broader purpose of the legislation, especially post‑EU law and Human Rights Act 1998 contexts (Pepper v Hart 1993 permits reference to Hansard). Presumptions include against alteration of common law, against retrospective effect, and in favour of compliance with international treaties.
12. Judicial Precedent Formula |
Binding Precedent = Ratio Decidendi + Material Facts + Court Hierarchy
The ratio decidendi is the legal principle which forms the basis of the decision — the reason for deciding. Only decisions of superior courts bind lower courts. The Supreme Court binds all below but may depart from its own precedent under the 1966 Practice Statement. The Court of Appeal is bound by its own decisions unless an exception applies (Young v Bristol Aeroplane 1944). Persuasive precedent includes obiter dicta, decisions of lower courts, and foreign judgments. Distinguishing on material facts allows courts to avoid an otherwise binding precedent. Overruling removes a precedent; reversing changes the decision on appeal.
