📚 Cambridge IGCSE Law High-Frequency Topics and Common Mistakes | 剑桥 IGCSE 法律高频考点与易错题分析
Cambridge IGCSE Law exams consistently test a core set of principles, yet many students lose marks on the same areas year after year. Understanding what examiners look for and recognising where errors commonly occur can make the difference between a grade C and an A*. This article examines the most frequently assessed topics and the typical mistakes candidates make, with clear explanations to help you avoid them.
1. Sources and Classification of Law |
English law derives from two principal sources: legislation (statute law) made by Parliament and common law developed by judges through decided cases. A third historical source, equity, supplements the common law where legal remedies are inadequate. Public law governs the relationship between the state and individuals (e.g., constitutional law, criminal law), while private law regulates disputes between citizens (e.g., contract, tort). Candidates frequently confuse 'common law' as a source with 'common law' as a legal system, or fail to distinguish between primary and delegated legislation.
Common errors include calling the Supreme Court 'the House of Lords' without acknowledging the 2009 constitutional change, and describing delegated legislation without giving an example such as statutory instruments or by-laws. When defining 'rule of law', students often give a vague phrase rather than referencing Dicey's three core principles: no arbitrary power, equality before the law, and the constitution as a result of ordinary law.
2. Judicial Precedent: Ratio and Obiter |
The doctrine of precedent (stare decisis) binds lower courts to follow the decisions of higher courts in cases with materially similar facts. The binding part of a judgment is the ratio decidendi – the legal principle necessary for the decision. Any remarks made 'by the way' are obiter dicta, which are persuasive but not binding. A classic example is Donoghue v Stevenson [1932], where the ratio established a duty of care owed by manufacturers to ultimate consumers, while Lord Atkin's broader 'neighbour principle' was initially obiter.
Examiners repeatedly highlight that students cannot accurately identify the ratio of a case. Many simply recite the facts and the outcome without extracting the legal rule. Another trap is describing the Court of Appeal as bound by its own previous decisions without stating the exceptions from Young v Bristol Aeroplane Co Ltd [1944]: conflicting decisions, decisions given per incuriam, and decisions inconsistent with a later Supreme Court ruling. The hierarchy of courts must be learned precisely; misplacing the position of the High Court or the Crown Court is a frequent mark-loser.
3. Statutory Interpretation Approaches |
When a statute's meaning is unclear, judges apply established rules of interpretation. The literal rule gives words their plain, ordinary dictionary meaning, even if the result seems harsh. The golden rule allows a departure from the literal meaning where it would lead to an absurdity. The mischief rule, the oldest, looks at the gap in the law that Parliament intended to fill. Finally, the purposive approach interprets legislation in light of its overall purpose, widely used in EU-derived law and now post-Brexit retained law. Key cases: Whitely v Chappell (literal rule leads to absurd acquittal), Re Sigsworth (golden rule prevented a son who murdered his mother from inheriting her estate), Smith v Hughes (mischief rule applied to the Street Offences Act), and Pepper v Hart allowing reference to Hansard under the purposive approach.
关键案例:Whitely v Chappell(文义规则导致荒谬的无罪判决),Re Sigsworth(黄金规则阻止谋杀母亲的儿子继承其遗产),Smith v Hughes(除弊规则适用于《街头犯罪法》),以及 Pepper v Hart 允许在目的解释下查阅议会议事录。
A high-frequency mistake is mixing up the golden rule and the mischief rule. Remember: the golden rule is a modification of the literal rule to avoid absurdity; the mischief rule is a broader inquiry into the pre-existing law and the remedy Parliament intended. Also, candidates often fail to connect the rules with appropriate aids: intrinsic aids (e.g., long title, interpretation sections) and extrinsic aids (e.g., dictionaries, Hansard, Law Commission reports). The Interpretation Act 1978 also provides standard definitions that students should know for the exam, such as 'month' meaning calendar month and 'person' including corporate bodies unless stated otherwise.
4. Actus Reus: Conduct, Consequences, and Omissions |
The actus reus is the external element of a crime. It can consist of conduct (e.g., driving), consequences (e.g., causing death), or a state of affairs (e.g., being found drunk on a highway). Crucially, an omission (failure to act) does not generally create criminal liability unless a duty to act exists. Duties arise from: a specific statutory duty, a contract, a special relationship (parent–child), voluntary assumption of care, creating a dangerous situation, or a public office. In the well-known case R v Gibbins and Proctor, a father and his partner starved his child to death; the father's duty arose from the relationship, the partner's from voluntary assumption of care.
The most common error here is stating that 'an omission can never form the actus reus' without explaining the exceptions. Another weak point is causation. In result crimes, the prosecution must prove factual causation (the 'but for' test) and legal causation (the defendant's act was the substantial and operating cause). Students often confuse the two or fail to mention the principle of 'take your victim as you find them' (the thin skull rule): R v Blaue.
5. Mens Rea: Intention and Recklessness |
Mens rea is the internal or mental element. The two main levels are intention and recklessness. Direct intention is where the defendant desires the consequence. Oblique intention applies where the consequence is virtually certain and the defendant appreciates that certainty: R v Woollin. Recklessness in English law after R v G and another [2003] is subjective: the defendant must foresee the risk of the prohibited consequence and unreasonably take that risk. The old objective Caldwell test no longer applies for most offences, though a few statutory exceptions remain (e.g., criminal damage offences in some contexts are now covered by the Criminal Damage Act 1971 as interpreted in G).
R v G and another
Candidates often misapply oblique intention, claiming it is simply foreseeing a risk, which is actually the definition of recklessness. Oblique intention requires virtual certainty and the defendant's appreciation of it. Another recurring mistake is forgetting that mens rea and actus reus must coincide in time unless the courts apply the 'series of acts' doctrine or a continuing act theory, as in Fagan v Metropolitan Police Commissioner where driving onto an officer's foot (accidental) followed by refusing to move (intentional) formed a single continuing act.
6. Strict Liability Offences |
Strict liability offences require no mens rea for at least one element of the actus reus. The prosecution only needs to prove the physical act, making defences of honest and reasonable mistake generally unavailable. Such offences are usually statutory, regulatory in nature, and protect public health, safety, or morality. Examples include selling food past its use-by date, driving without insurance, and, historically, statutory rape as in R v Prince. Courts presume mens rea is required unless Parliament clearly indicates otherwise, considering factors such as the wording of the statute, the social danger involved, and the severity of the penalty.
Students often assert that strict liability offences require 'no mens rea at all', which is an oversimplification. True strict liability might still require mens rea for some elements, e.g., the act itself must be voluntary. A more precise formulation is that strict liability dispenses with mens rea in relation to one or more elements. Also, memorise the four key factors courts use to decide whether an offence is of strict liability: (1) the presumption of mens rea, (2) the wording of the Act, (3) the mischief the Act seeks to prevent, and (4) whether the penalty is severe. The case of Sweet v Parsley emphasised the presumption of mens rea where the offence carries a serious social stigma.
7. Non-Fatal Offences: Assault, Battery, ABH and GBH |
The main non-fatal offences under the Offences Against the Person Act 1861 and common law are assault (causing the victim to apprehend immediate unlawful force), battery (the actual infliction of unlawful force), assault occasioning actual bodily harm (ABH) under s.47, malicious wounding or inflicting grievous bodily harm (GBH) under s.20, and wounding or causing GBH with intent under s.18. 'Bodily harm' includes psychiatric injury but not mere emotional distress, following R v Chan-Fook.
Examiners frequently see the wrong offence charged in problem questions. For example, students apply s.20 GBH to a push causing a minor bruise, which should be battery or s.47 at most. The mens rea must match: s.47 requires the mens rea for assault or battery only (intention/recklessness as to contact), whereas s.20 requires intention or recklessness as to some harm (even minor). For s.18, the additional specific intent to cause serious injury must be proved. A common mistake is to assume 'maliciously' in s.20 means ill will; in law it simply means intentionally or recklessly.
8. Property Offences: Theft and Robbery |
Theft is defined by s.1 of the Theft Act 1968: the dishonest appropriation of property belonging to another with the intention of permanently depriving the other of it. Each element opens subtleties. 'Appropriation' includes assuming any rights of the owner, even with consent if obtained by deception: R v Hinks. 'Property' includes money, personal items, things in action, and intangible property, but not wild mushrooms or flowers unless for commercial purpose. 'Belonging to another' captures situations where a person receives property under an obligation to deal with it in a particular way: s.5(3). The Ghosh test for dishonesty has been replaced by the Ivey v Genting Casinos [2017] test: what was the defendant's actual state of knowledge or belief, and was the conduct dishonest by the standards of ordinary decent people?
Robbery under s.8 is simply theft with the use or threat of force immediately before or at the time of stealing. If the force occurs after the theft is complete, it is not robbery but separate offences. Students fail by treating every violent snatching as robbery without analysing whether there is a completed theft first; if there is no appropriation, there can be no robbery. Also, the force must be against the person, not property, and must be used in order to steal.
9. Criminal Defences: Self-defence and Intoxication |
Self-defence (and defence of another and prevention of crime) are governed by common law and s.3 of the Criminal Law Act 1967. The force must be necessary and proportional. The necessity of force is judged subjectively based on the defendant's genuine, even if mistaken, belief in the circumstances as in R v Williams (Gladstone). However, a mistake induced by voluntary intoxication cannot be relied upon. The degree of force is judged objectively—was it reasonable in the circumstances as the defendant believed them to be? A householder in a dwelling case may use disproportionate but not grossly disproportionate force under s.76 of the Criminal Justice and Immigration Act 2008.
Intoxication affects mens rea. Voluntary intoxication is a defence only to crimes of specific intent (e.g., s.18 GBH, murder) where it prevented the defendant forming the required intent. For basic intent crimes (e.g., assault, battery, s.47, s.20, manslaughter), voluntary intoxication provides no defence, as recklessness suffices and getting intoxicated is itself reckless. Involuntary intoxication (e.g., drink spiked) is a defence to any offence if the defendant lacked the required mens rea. Candidates confuse this categorisation repeatedly. A table helps:
| Involuntary | 非自愿 | Defence if mens rea absent | 若无犯意可辩护 | Defence if mens rea absent | 若无犯意可辩护 |
Failure to recall key case names like R v Majewski and R v Kingston significantly weakens answers. Also, remember that intoxication is not a 'defence' per se but a denial of mens rea; the burden rests on the prosecution to prove the requisite intent beyond reasonable doubt.
10. Tort: Duty of Care and Breach in Negligence |
To establish negligence, a claimant must prove: duty of care, breach of that duty, and damage caused by the breach. The modern duty of care test from Caparo Industries plc v Dickman [1990] asks: (1) was harm reasonably foreseeable? (2) was there sufficient proximity between the parties? (3) is it fair, just and reasonable to impose a duty? Additionally, established categories (e.g., driver– pedestrian, doctor–patient) are automatically applied. Breach occurs when the defendant falls below the standard of the reasonable person: Blyth v Birmingham Waterworks Co. Factors include the probability of harm, the seriousness of potential injury, the cost of precautions, and the social utility of the activity.
Learners often omit the third Caparo stage, treating the test as only foreseeability and proximity. They also misapply the standard of care to professionals: the standard is that of a reasonably competent member of that profession, not the best possible practice, as per Bolam v Friern Hospital Management Committee [1957], now qualified by Bolitho where professional opinion must be logically defensible. The 'egg-shell skull' rule applies to the extent of damage once breach and causation are proved.
11. Contract Formation: Offer, Acceptance, and Consideration |
A binding contract requires offer, acceptance, consideration, and intention to create legal relations. An offer is an expression of willingness to contract on certain terms, to be distinguished from an invitation to treat (e.g., display of goods, advertisements). Acceptance must be communicated and mirror the terms of the offer; silence cannot constitute acceptance: Felthouse v Bindley. The postal rule states that acceptance by post takes effect upon posting, not receipt, but this only applies where post is a reasonable mode of communication. Consideration must move from the promisee but need not be adequate; past consideration is generally not valid consideration unless under the doctrine in Pao On v Lau Yiu Long (act done at promisor's request, parties understood payment, and promise would have been enforceable).
Pao On v Lau Yiu Long
Frequent pitfalls: confusing counter-offers with mere requests for information (Stevenson, Jacques & Co v McLean), forgetting that revocation of an offer must be communicated to the offeree, and failing to distinguish between unilateral and bilateral contracts. In problem questions, systematically go through the elements: identify the offer, the acceptance event, and state the moment the contract is formed. For consideration, the rule that part payment of a debt is not good consideration for the whole debt (Pinnel's Case) and its exceptions, such as promissory estoppel (Central London Property Trust Ltd v High Trees House Ltd), are favourite exam topics.
12. Common Pitfalls and Final Tips |
Many candidates lose marks not because they lack knowledge, but because they fail to apply the law to the facts. Always use the IRAC method (Issue, Rule, Application, Conclusion) or a similar structured approach in problem questions. State the rule with authority (case or statute), then explain how the facts satisfy or fail each element. Merely describing the law without application limits marks to lower bands.
Also, precise language matters. Use 'the defendant is liable' not 'the defendant is guilty' in civil cases. Distinguish between 'burden of proof' (prosecution/claimant) and 'standard of proof' (beyond reasonable doubt in criminal, on the balance of probabilities in civil). Remember that in criminal law, the defendant generally bears the evidential burden for defences, but the legal burden remains on the prosecution to disprove the defence. Essays should show critical evaluation, such as discussing the uncertainty in the Caparo test or the difficulties of the law on intoxication, to access higher marks.
Finally, keep a concise list of the most cited cases (at least 30) with a one-line principle and the decision. For each topic, know a primary case and a contrasting case. The examiner wants evidence of reading beyond the textbook and the ability to use case law as a tool, not as decoration.
