📚 Core Knowledge for Year 12 CIE Law | Year 12 CIE
The Cambridge International AS Level Law syllabus introduces students to the fundamental structures, processes and principles of the English legal system and a substantive area of law – typically Criminal Law. Understanding the interplay between legal institutions, sources of law and the definition of offences is vital for success in Papers 1 and 2. This revision guide distils the core knowledge you must master, presenting each topic in a systematic way with paired English and Chinese explanations to reinforce your learning.
1. The English Legal System: Common Law Heritage |
England and Wales operate a common law system, meaning that much of the law has been developed through decisions of judges in individual cases over centuries, rather than being wholly codified in statutes. This judicial creativity is the foundation of the doctrine of precedent, where courts are bound by earlier rulings of higher courts. The system is also adversarial: two opposing sides present their cases to a neutral judge or jury, who decides the outcome based on the evidence and arguments. Alongside case law, Acts of Parliament (statute law) are the supreme source of law and can override any judge‑made law.
2. Sources of Law: Case Law and Statute Law |
Case law is built upon two key elements in a judgment: the ratio decidendi (the legal reason for the decision) and obiter dicta (other remarks made ‘by the way’). Only the ratio is binding on future courts within the same hierarchy, while obiter may be persuasive. A powerful example is the neighbour principle from Donoghue v Stevenson (1932), which founded the modern law of negligence. Statute law consists of Acts of Parliament, created by the House of Commons, House of Lords and the Crown. Primary legislation is supplemented by delegated legislation (statutory instruments, by‑laws), which allow ministers or local authorities to make detailed rules without a full Act. Conflicts between case law and statute are resolved in favour of statute under the doctrine of parliamentary sovereignty.
3. Judicial Precedent: Hierarchy, Binding and Persuasive |
Precedent operates through the court hierarchy. Decisions of the Supreme Court (formerly the House of Lords) bind all lower courts; the Court of Appeal binds itself (subject to the exceptions established in Young v Bristol Aeroplane) and all inferior courts; High Court decisions bind lower courts but are not strictly binding on other High Court judges, though they are strongly persuasive. Lower courts such as the Crown Court and Magistrates’ Court do not create binding precedent. To avoid unjust outcomes, judges may ‘distinguish’ a case by finding material differences in facts, ‘overrule’ a precedent in a higher court, or ‘reverse’ a decision on appeal. Persuasive precedents include obiter dicta, decisions of the Privy Council, and rulings of courts in other common law jurisdictions.
4. Statutory Interpretation: Rules and Aids |
When applying legislation, judges must interpret the words of Parliament. Four traditional rules guide this task. The literal rule gives words their plain, ordinary meaning, even if the result seems harsh (Whiteley v Chappell). The golden rule modifies the literal meaning to avoid an absurd outcome (Re Sigsworth). The mischief rule looks at the ‘mischief’ the Act was intended to remedy, as established in Heydon’s Case. The modern purposive approach, influenced by EU law, goes further and asks what purpose Parliament sought to achieve (Pepper v Hart allowed reference to Hansard). Judges use intrinsic aids (the statute itself, including long title, preamble, interpretation sections) and extrinsic aids (prevailing legal dictionaries, Law Commission reports, Hansard, treaties) to assist interpretation.
5. Courts and Process: Criminal and Civil |
Criminal cases categorise offences into three types. Summary offences (e.g. common assault) are tried in the Magistrates’ Court. Indictable offences (e.g. murder, robbery) must be tried in the Crown Court before a judge and jury. Triable either way offences (e.g. theft, ABH) may be heard in either court, depending on the defendant’s plea and the magistrates’ assessment of seriousness. Civil cases are allocated to one of three tracks in the County Court or High Court: small claims track (typically under £10,000), fast track (£10,000–£25,000) and multi‑track (over £25,000 or complex issues). Appeals generally move from the lower court to the Court of Appeal and potentially to the Supreme Court, though leave to appeal is often required.
6. Legal Personnel: Judges and Juries |
Judges are appointed from experienced barristers or solicitors by the Judicial Appointments Commission, based on merit and ability. In the Crown Court, the judge rules on questions of law and directs the jury on the relevant legal principles; the jury decides the facts and returns a verdict. Juries in criminal cases consist of 12 adults aged 18–75, selected at random from the electoral register. Jury verdicts need not be unanimous; a majority of 11–1 or 10–2 may be accepted. While juries promote public participation and ‘jury equity’ (the power to acquit in defiance of the law, as in R v Ponting), critics point to risks of bias, difficulty understanding complex evidence, and the lack of reasoned judgments.
7. Criminal Law: Actus Reus and Mens Rea |
Most crimes require proof of two elements beyond reasonable doubt: the actus reus (the external element) and the mens rea (the mental element). Actus reus can consist of a voluntary act, a failure to act where a duty exists (omission), or certain circumstances that constitute the prohibited conduct. Causation must be established: factual causation (the ‘but for’ test – R v White) and legal causation (the defendant’s act must be a substantial and operating cause of the result, as in R v Smith). Mens rea levels range from intention (direct or oblique — a result is virtually certain and the defendant foresaw it, R v Woollin) to recklessness (conscious taking of an unjustified risk, R v Cunningham) and, for some offences, negligence.
8. Strict Liability Offences |
A small category of crimes, largely regulatory, require no proof of mens rea for at least one element of the actus reus. These strict liability offences are primarily designed to protect public health, safety or the environment. Examples include selling alcohol to a person under age (Harrow LBC v Shah) and driving without a licence or insurance. When determining whether an offence is strict liability, courts start with the presumption that mens rea is required, but they may displace this if the statute concerns a matter of social concern, if the wording suggests it, and if the penalty is relatively minor (Gammon v Attorney‑General of Hong Kong). The principal justification is that strict liability promotes higher standards of care and eases the prosecution’s evidential burden, though critics argue it can be unjust where the defendant exercised all due diligence.
9. Non‑fatal Offences Against the Person |
The key hierarchy under the Offences Against the Person Act 1861 and the Criminal Justice Act 1988 is as follows. Assault (common assault) is causing another to apprehend immediate unlawful violence, with intention or recklessness — no touching is required (Smith v Chief Constable of Woking). Battery is the actual infliction of unlawful force, however slight (Collins v Wilcock). Assault occasioning actual bodily harm (s.47) covers any hurt calculated to interfere with health or comfort, including psychiatric injury but not mere emotions (R v Miller). Malicious wounding or inflicting grievous bodily harm (s.20) requires a wound (break of both layers of skin) or really serious harm, with mens rea of ‘malice’ — meaning intention or recklessness. Wounding or causing GBH with intent (s.18) carries a maximum life sentence and demands proof of specific intent to cause GBH or to resist arrest.
10. Property Offences: Theft, Robbery and Burglary |
Under the Theft Act 1968, theft involves the dishonest appropriation of property belonging to another with the intention permanently to deprive. Appropriation is defined widely as any assumption of the owner’s rights (R v Morris). Dishonesty is judged by a two‑stage test established in R v Ghosh, updated by Ivey v Genting Casinos to a single objective test: was what the defendant did dishonest according to the standards of ordinary decent people? Robbery is theft immediately before, at the time of, or immediately after which the defendant uses force or threatens force to steal. The force need only be slight (R v Clouden). Burglary under s.9(1)(a) occurs when a person enters a building as a trespasser with intent to steal, inflict GBH or cause damage; s.9(1)(b) applies when, having entered as a trespasser, the person actually commits theft or GBH.
11. Defences in Criminal Law |
The broadest defence is self‑defence and prevention of crime; the defendant must have genuinely believed the use of force was necessary, and the force must be reasonable in the circumstances as the defendant perceived them (R v Owino, codified in the Criminal Justice and Immigration Act 2008). Intoxication is only a defence if it negates the specific intent for a crime; voluntary intoxication provides no defence to crimes of basic intent (DPP v Majewski), except where the substance was taken in a non‑reckless manner. Insanity (M’Naghten Rules) requires proof of a defect of reason from disease of the mind so that the defendant did not know the nature and quality of the act or that it was wrong. Automatism is an involuntary act caused by an external factor, such as a blow to the head, and leads to full acquittal. Duress (threats of death or serious injury) and necessity (choosing the lesser evil, Re A (conjoined twins)) operate in narrow circumstances.
12. Access to Justice and Legal Aid |
Access to justice ensures that citizens can enforce their rights and defend themselves, regardless of financial means. The Legal Aid, Sentencing and Punishment of Offenders Act 2012 significantly restricted the availability of public funding. Civil legal aid is now mainly limited to cases involving domestic abuse, public law challenges, mental health and immigration detention. Criminal legal aid is means‑tested and generally available at the Magistrates’ Court; at the Crown Court, those with higher income may be required to contribute. Alternative sources of funding include conditional fee agreements (‘no win, no fee’) and legal expenses insurance, although these may not cover all case types. The cuts to legal aid have prompted ongoing debate about whether the most vulnerable in society are being denied a fair hearing.
