📚 Year 12 CIE Law: High-Frequency Exam Topics and Common Mistake Analysis | Year 12 CIE
Mastering CIE AS Level Law requires not only knowing the legal rules but also understanding how to apply them accurately and avoid the traps that examiners love to set. This article breaks down the topics that appear most frequently in past papers, pinpoints where students lose marks, and gives clear, bilingual guidance to sharpen your technique.
1. Actus Reus and Omissions: The Key Principles |
The actus reus of a crime can be an act, a state of affairs, or an omission where a duty to act exists. Students often forget that omissions are not criminal unless a recognised duty under English law applies, such as a contractual duty (Pittwood), a duty arising from a relationship (Gibbins and Proctor), or a duty taken on voluntarily (Stone and Dobinson).
A common mistake is treating a moral duty as a legal duty. For CIE, you must name the specific case that created the duty and explain why the defendant’s failure to act satisfied the actus reus. Do not simply state that the defendant 'did nothing' without linking it to a duty.
2. Causation: Factual and Legal |
Causation is almost always examined alongside murder or manslaughter. Factual causation uses the 'but for' test (White). Legal causation requires that the defendant’s act was the operating and substantial cause of the result (Smith). Students often lose marks by failing to discuss intervening acts that could break the chain of causation.
Intervening acts include freak natural events, third party interventions, and the victim’s own actions. Remember that acts of a third party that are 'free, deliberate and informed' (Pagett) will break the chain. Medical negligence rarely breaks the chain unless it is so potent as to make the original wound merely the background (Cheshire).
3. Mens Rea: Intention and Recklessness |
In CIE Law, direct intent (Moloney) and oblique intent (Woollin) are core concepts. A frequent error is confusing oblique intent with recklessness. Oblique intent applies when a result is virtually certain and the defendant appreciates that certainty. Recklessness is the taking of an unjustified risk (Cunningham subjective recklessness).
When writing about recklessness, always specify that the test is subjective: did the defendant foresee the risk and go on to take it? Do not accidentally apply the old objective Caldwell test, which is not the law for non-fatal offences. For criminal damage, however, the position may differ depending on the CIE syllabus emphasis, so check your specification.
4. Strict Liability: Essentials and Common Errors |
Strict liability offences require actus reus but no mens rea. Students often mislabel absolute liability offences as strict liability. The key distinction is that strict liability still requires the act to be voluntary, whereas absolute liability involves state of affairs where even voluntariness is irrelevant (Larsonneur).
To identify a strict liability offence in a problem question, apply the Gammon test, looking at the presumption of mens rea, the wording of the statute, the mischief the Act addresses, and the severity of the penalty. Many students simply assert an offence is strict liability without working through these criteria, losing evaluation marks.
5. Non-Fatal Offences: Distinguishing Assault, Battery, ABH, GBH |
This topic generates a large number of marks in the exam. Assault is causing another to apprehend immediate, unlawful force (Logdon). Battery is the actual infliction of unlawful force (Collins v Wilcock). ABH under s.47 requires any hurt or injury calculated to interfere with health or comfort (Miller).
For s.20 and s.18 GBH, a classic error is using the mens rea for s.20 (some harm) interchangeably with s.18 (intent to cause grievous bodily harm or resist arrest). Table 1 outlines the essential differences:
| Offence | Actus Reus | Mens Rea |
|---|---|---|
| s.47 ABH | Assault or battery causing actual bodily harm | Intention or recklessness as to assault/battery |
| s.20 GBH | Wounding or inflicting grievous bodily harm | Intention or recklessness as to some harm |
| s.18 GBH | Wounding or causing grievous bodily harm with intent | Specific intention to cause GBH or resist arrest |
6. Murder: Definition and Partial Defences |
Murder is the unlawful killing of a human being under the Queen’s peace with malice aforethought. For CIE, the definition is straightforward, but the real challenge is applying the partial defences to reduce murder to voluntary manslaughter. Never confuse a partial defence with a full defence; they only reduce liability, they do not acquit.
7. Voluntary Manslaughter: Loss of Control vs Diminished Responsibility |
Loss of control (Coroners and Justice Act 2009, s.54–55) requires a qualifying trigger, either fear of serious violence or things said/done of an extremely grave character giving a justifiable sense of being seriously wronged. Students frequently misapply the trigger by citing trivial arguments. The test is objective: would a person of the defendant’s age and sex, with a normal degree of tolerance and self-restraint, have acted similarly?
Diminished responsibility (s.2 Homicide Act 1957, amended) requires an abnormality of mental functioning arising from a recognised medical condition that substantially impairs the defendant’s ability to understand the nature of their conduct, form rational judgment, or exercise self-control. A typical error is treating intoxication as a medical condition; voluntary intoxication alone cannot ground diminished responsibility, but alcoholism may if it constitutes a recognised condition (Wood).
8. Involuntary Manslaughter: Unlawful Act and Gross Negligence |
Unlawful act manslaughter requires an intentional act (not omission), which is unlawful, dangerous on an objective test (Church), and causes death. A mistake many students make is using an omission as the base crime — for involuntary manslaughter, an omission alone is not enough unless it falls within gross negligence manslaughter.
Gross negligence manslaughter (Adomako) requires a duty of care, a breach of that duty, a risk of death, causation, and gross negligence so serious as to amount to a crime. The mistake here is failing to distinguish between civil negligence and gross negligence; the jury must find that the conduct was truly exceptionally bad.
9. Property Offences: Theft, Robbery, Burglary |
Theft is defined in s.1–6 Theft Act 1968. The five key elements are appropriation, property, belonging to another, dishonesty, and intention to permanently deprive. In exam answers, always analyse dishonesty using the two-stage Ghosh test (now modified in some jurisdictions, but Ghosh remains the CIE standard). Many candidates fail to mention the second limb: would the defendant’s conduct be regarded as dishonest by the standards of ordinary reasonable people?
Robbery is theft plus force or threat of force immediately before or at the time of stealing. Burglary under s.9(1)(a) is entering a building as a trespasser with intent to commit theft, GBH or criminal damage. Under s.9(1)(b), it is having entered as a trespasser and then committing theft or GBH. A common error is applying s.9(1)(b) when the defendant had the intent at the time of entry — that is s.9(1)(a).
10. General Defences: Intoxication and Consent |
Intoxication can be voluntary or involuntary. Voluntary intoxication is only a defence to specific intent crimes where it prevents the defendant from forming the mens rea (Majewski). It cannot be a defence to basic intent crimes because the recklessness of becoming intoxicated substitutes for mens rea. A fatal exam error is applying intoxication as a defence to crimes requiring only recklessness, such as assault or battery.
Consent is a defence to battery and ABH as long as the harm is not too serious and the activity is lawful (Brown). Sport, surgery, and tattooing are exceptions where consent may be valid even for higher levels of harm. Students often fail to discuss the public policy limitation: consent is not available where the harm is intended or foreseen as highly likely beyond a threshold of legality.
11. Evaluation: How to Structure a High-Scoring Answer |
Evaluation questions require critical analysis, not simply description. A strong answer identifies a weakness in the current law, illustrates it with a case or example, discusses the impact, and where possible, refers to reform proposals or academic commentary. Vague statements like 'the law is unfair' without specific reasoning will earn few marks.
A useful structure is PEEEL: Point, Explain, Evidence, Evaluate, Link. For example, when evaluating theft, you might point out that the Ghosh test on dishonesty creates uncertainty. Explain that a mixed subjective–objective test may lead to inconsistent jury outcomes. Evidence it with cases like Feely. Evaluate by contrasting with the Ivey test. Link back to the need for reform.
12. Common Exam Traps and Time Management |
The most frequent traps include: misidentifying the victim in an assault scenario, applying loss of control when there was a considered desire for revenge, using the general defence of intoxication for a basic intent crime, and mixing up the mens rea for s.20 and s.18 wounding. Always read the question carefully for clues about the defendant’s state of mind and any time lapse.
Time management is critical. For the CIE AS Law paper, divided into problem and essay questions, allocate roughly 1.5 minutes per mark. If a question is worth 25 marks, plan for 5 minutes, write for 30 minutes, and review for 2–3 minutes. Do not sacrifice evaluation to give a perfect actus reus description — evaluative comments elevate a script into the top band.
